Chapter 268, WATERFRONT CONSISTENCY REVIEW
Wetland Permit for STEIN FAMILY RFSIDENCE TRUST
SCTM#37-4-10
Ray Nemschick, R.A. on behalf of STEIN FAMILY RESIDENCE TRUST requests a Wetland Permit to construct a one-story
addition to the existing single-family dwelling, new front porch and a half-story addition with utility (1) toilet (1) sink to
existing one-story garage. Located: 2535 Cedar Lane, East Marion. SCTM#37-4-10
The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of $outhold Town Code
and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the
LWRP Consistency Assessment Form submitted to this department, as well as the records available to us, it is our
recommendation that the proposed action is INCONSISTENT with LWRP policy standards and therefore is
INCONSISTENT with the LWRP.
Policy 6 Protect and restore the quality and function of the Town of Southold ecosystem
6.3 Protect and restore tidal and freshwater wetlands.
A. Comply with statutory and regulatory requirements of the SouthoM Town Board of Trustees laws and regulations
for all Andros Patent and other lands under their jurisdiction
1. Comply with Trustee regulations and recommendations as set forth in Trustee permit conditions.
§ 275-3 Findings; purpose; jurisdiction; setbacks.
C. Jurisdiction: The following areas are subject to protection under Chapter 275 of the Code of Southold.
(1) Any freshwater wetland tidal wetland beach, bluff, dune, fiat, marsh, swamp, wet meadow, bog, or
vernal pool;
The [bllowing minimum setbacks apply to arty and all operations prnposed on resklential property within the
jurisdiction of the Board qf l?ustees:
(a) Wetland boundary.
[l] Residence: lOOfeel.
The distance from the bulkhead to the proposed actions is less than 100 feet[ a minimum setback distance of 100 feet
from the wetland boundary (bulkhead) is required pursuant to Chapter 275-3. Findings~ purpose~ iurisdiction; setbacks.
Please require that the applicant amend the application to meet the above policy to the greatest extent practicable.
Note: During a site inspection to the above referenced propert% it was discovered that storm water is being directly
discharged into Spring Pond via an outflow pipe positioned in the bulkhead (see Figures # 1~ 2 & 3). It is our
recommendation that all surface waters generated from impervious surfaces be kept on site through infiltration and
retention. Please require that the application amend the application to address the storm water drainage system
pursuant to § 275-11.
Policy 5 Protect and improve ~vater quality and supply in the Town of Southold.
5.2 Minimize non-point pollution of coastal waters and manage activities causing nonpoint pollution.
A. Minimize non-point pollution qf coastal waters' using the fi)llowing approaches, which are presented in order of priority.
1. Avoid non-point pollution by limiting non-point sources,
c. Control and manage stormwater ranof[: to:
· minimize transport of pollutants
· restore sites to emulate natural stormwater runoffconditions where degraded stormwater runoffconditions exist
§ 275-11 Construction and operation standards.
A. General The following standards are required for all nperations within the jurisdiction qf the 7Yustees:
(1) Drainage upgrade. Applicants.~br a permit fi)r any,[brm qf construction ma~; be required to upgrade the site's drainage
system such that all surJLtce water generated from impervious su~[~ces shall be kept onsite through infiltration or retention.
Applicants proposing grading or filling operations will be required to submit a drainage plan.I'br the entire site at the
discretion of the Trustees. See ,~' 275-6A(14) Jbr requirements.

If the agency, Board of Trustees makes a contrar3' determination of consistency, the agency shall elaborate in writing
the basis for its disagreement with their recommendations Pursuant to Chapter 268 Waterfront Consistency Review.

determination regarding the consistency of the proposed action.
