No. 6124 (Manfredi) The proposed deck reconstruction has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this dcpartment, as well as the records available to me, it is my recommendation that the proposed action is exempt from review pursuant to Chapter 268-3, Exempt Minor Actions, item B which states: "Replacement, rehabilitation or reconstruction of a structure or facility, in kind, on the same site, including upgrading buildings to meet building or fire codes, except for structures in areas designated by' the Coastal Erosion Hazard Area (CEHA) law where structures' may not be replaced, rehabilitated or reconstructed without a permit ". The proposed fence is CONSISTENT with the Policy Standards and therefore is CONSISTENT with the LWRP. If thc actiou is approved the following best management practices (BMP's) are recommended: I. Require a non-turf, native vegetation buffer landward of the xvetlaud line. 2. Minimize lawn areas and irrigation to reduce the influx of herbicides, pesticides, and fertilizers into the wetland. The BMP's will further Policies 5, Protect and improve water quality in the Town of Southold and 6.3 Protect and restore tidal and fi'eshwater wetlands, item D (below).
