SCTM#1000-141-3-44 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department as well as the records available to me, it is my determination that the proposed action is CONSISTENT with the Policy Standards and therefore is CONSISTENT with the LWRP. Pursuant to Chapter 268, the Planning Board shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. Gerard Holdings LLC and Seifert Construction Property Location: 11780 Sound Avenue, Mattituck CTM 141-3-44 SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without further steps under SEQRA. PROPERTY FACTS/DESCRIPTION: The applicant's property size is only 78 feet wide by 132 feet deep along the easterly side line. The dilapidated, unhabitable remnants of a former dwelling has been located on at the site for a long time and shown on the December 18, 2006 survey prepared by Joseph A. Ingegno. BASIS OF APPLICATION: Zoniog Code Sections 280-63 and 280-64, based on the Building Inspector's June 4, 2007 amended Notice of Disapproval concerning proposed construction for use as a custom workshop in this LI Light Industrial Zone District. The reasons stated for disapproving the building permit application are that the new construction will be: (1) less than 100 feet from the right-of-way; (2) will have a single side yard t less than 10 feet; (3) will have a total side yards at less than 40 feet for both setbacks, (4) the rear yard is less than 70 feet. SUFFOLK COUNTY ADMINISTRATIVE CODF: This application has been referred as required under the Suffolk County Administrative Code Sections A I4-14 to 23, and the Suffolk County Department of Planning reply dated July 25, 2007 states that the application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP: This application is exempt under Chapter 268. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on _2006, at which time written and oral ¢.vidence were presented Rased upon al! test.mony, docomemation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: AREA VARIANCE RELIEF REQUESTEr): The applicant proposes a 40' by 78' contractor's office-warehouse building with storage of custom carpentry materials and as a limited workshop clarified by the applicant during the August 2, 2007 public hearing. The new building will include a 6' by 40' one-story open porch, a two-story office area 40' by 21', and one-story warehouse floor area. This property is in the LI zone and contains a size of 11,517.67 square feet. The May 31, 2007 site plan (Map S-2) shows the new building with a front open porch proposed at 19 foot from the front lot line facing Sound Avenue instead of the required 100 feet, a rear yard setback of 42.1 feet instead of 70 feet (measured from the closest corner), 10 feet on the west side yard Page 2 - August 16, 2007 ZB File No. 6059- FJ Gerard Hole .js and Self ed Consiruction CTM No. 141-3-44 and total side yard setbacks of 37.9 feet. The bulk schedule requires total side yard setbacks at 40 feet (10 feet on one side, and a minimum of 30 feet on the other side). REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: 1. Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. This area has many mixed uses, Residential and Industrial, with a building that is similarly situated. The applicant proposes to place the parking area behind the new business building, with removal of the entire dilapidated structure on the site and other site planning with the Planning Board. The applicants' planned improvements will be an asset to the area. 2. The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The applicant's property size is only 78 feet wide by 132 feet deep along the easterly side line, with a limited site area for parking, screening, and related site of only 11,517.67 feet in an Light Industrial (LI) Zone for construction of a business, new parking area, new sanitary system and related utilities. This lot is not large enough to meet the setback requirements to place a building, and the applicant is forced to follow a variance procedure to request multiple setback variances from both side lines, from the right- of-way (front yard), and from the rear lot line. 3. The variances requested are substantial, but the size of the property limits the use of this LI zoned land. The owner has devised a plan which meets his business needs and which will meet other code requirements as a permitted business use, and all improvements as planned will be aa asset to the community. 4. The difficulty has not been self-created inasmuch as the Town Board in 1989 deemed this property LI Light Industrial Zone District with setback requirements that would not be met on this lot of only 11,517 square feet in size. 5. No evidence has been submitted to suggest that a variance from the Light Industrial Zone District standards will have an adverse impact on the physical or environmental conditions in the neighborhood. Changes were agreed by the applicant during the hearing to reduce the width of the eastedy driveway by one foot and to narrow the warehouse by two feet, and providing adequate screening for the nearby residence(s). RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Oliva, seconded by Member Goehringer, and duly carried, to Grant the variances, with the following condition, and as shown on plans drawn by Mark Schwartz dated May 31, 2007: Reduction of the width of the easterly driveway by one foot, and reduction of the warehouse by two feet, to provide adequate screening for the residence(s). Any deviation from the variance given such as extensions, or demolitions which are not shown on the applicant's diagrams or survey site maps, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action.
