North, Southold, New York 11971, party of the second part,
WITNESSETH, that the party of the first part, in consideration of Ten
Dollars and other valuable consideration paid by the party of the second
part, does hereby grant and release unto the party of the second part, the
heirs or successors and assigns of the party of the second part forever,
ALL that certain plot, piece or parcel of land, with buildings and improvements thereon
erected, situate, lying and being in the Town of Southold, County of Suffolk and State
of New York, known 'and designated as Lot 39 on a certain map entitled, "Map of Oregon
View Estates" and filed in the office of the Clerk of the County of Suffolk on April 4,
1975 as Map No. 6241, being more particularly bounded and described as follows:
BEGINNING at a point on the northeasterly side of silver Colt Road at the extreme
westerly terminus of a curve which curve connects the northeasterly side of silver Colt
t)` Sl Road with the northwesterly side of Middle Road (C.R. 48) :
RUNNING THENCE along the northeasterly side of silver Colt Road the following 2
courses and distances:
1. North 44 de--- " 27• CFu 'Peat, 100 foot.•
2. Along the arc of a curve bearing to the left having a radius of 1131.41 feet, a
/ distance of 44.99 feet;
RUNNING THENCE North 43 degrees 15• 23" East, 251.02 feet;
RUNNING THENCE South 49 degrees 38• 25" East, 180.71 feet to the northwesterly side
of Middle Road (C.R. 48);
RUNNINGTHENCE along the northwesterly side of Middle Road (C.R. 48) the following
2 courses and distances:
1. South 45 degrees 32. 05" West, 241.22 feet;
2. Along the arc of a curve having a radius of 25 feet, a distance of 39.27 feet to the
northeasterly side of Silver Colt Road, the point or place of BEGINNING.
SAID premises being more commonly known as 80 silver Colt Road, Cutchogue, New York
11935.
SAID premises being and intended to be the same premises conveyed to LEON GORDON and
BARBARA J. GORDON by deed dated October 7th, 1987 and recorded in the Office of the Clerk
of Suffolk county on October 16, 1987 in Liber 10446, Page 75.
TOGETHER with all right, title and interest, if any, of the party of the
first part in and to any streets and roads abutting the above described
premises to the center lines thereof; TOGETHER with the appurtenances and
all the estate and rights of the party of the first part in and to said
premises; TO HAVE AND TO HOLD the premises herein granted unto the party
of the second part, the heirs or successors and assigns of the party of
the second part forever.
AND the party of the first part covenants that the party of the first part
has not done or suffered anything whereby the said premises have been
encumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien
Law, covenants that the party of the first part will receive the
consideration for this conveyance and will hold the right to receive such
consideration as a trust fund to be applied first for the purpose of
paying the cost of the improvement and will apply the same first to the
payment of the cost of the improvement before using any part of the total
of the same for any other purpose.
The word "party" shall be construed as if it read "parties" whenever the
sense of this indenture so requires.
IN WITNESS WHEREOF, the party of the first part has duly executed this
deed the day and year first above written. 1
