Woodhouse, Chair Members of the Planning Board From: Mark Terry, Principal Planner ~ LWRP Coordinator Date: November 11, 2008 Re; Standard Subdivision of Peter and Gloria Onufr,al~ Located on the n/e comer of CR 48 and Mary's SCTM~1000-114-5-1 Zomg Disffict: R-80 Note, that the action is located directly north of County Route 48, a New York State Scenic Byway. The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided to this department, as well as the records available to me, it is my recommendation that the proposed action is CONSISTENT with the Policy Standards and therefore is CONSISTENT with the LWRP provided the following recommendation is implemented: To further Policy 3. Enhance visual quality and protect scenic resources throughout the Town of Southold A. Minimize introduction of structural design components (including utility lines, lighting, signage and fencing) which would be discordant with existing natural scenic components and character; and E. Preserve existing vegetation and establish new indigenous vegetation to enhance scenic quality: Preserve existing vegetation which contributes to the scenic quality of the landscape. It is recommended that the Board in the covenant and restrictions: Require a 75' vegetative buffer from County Route 48 property line, north, to contribute to the scenic quality of the CR 48 which is a New York State Scenic Byway. To further policies 5.1. Prohibit direct or indirect discharges that would cause or contribute to contravention of water quality standards; and 5.5. Protect and conserve the quality and quantity of potable water. A. Prevent contamination of potable waters by limiting discharges of pollutants to maintain water quality according to water quality classification, and limiting, discouraging or prohibiting land use practices that are likely to contribute to contravention of surface and groundwater quality classifications for potable water supplies; and 6.3. Protect and restore tidal and freshwater wetlands. It is recommended that the Board require in the covenant and restrictions: 1. Prohibit the use of synthetic herbicides, pesticides and fertilizers in the open space area on the parcel. 2. Require that the new driveway be constructed of pervious materials. Pursuant to Chapter 268, the Board shall consider this recommendation in preparing its wr/tten determination regarding the consistency of the proposed action. Ce: File
