Zuckerberg, ZIP Peconic Wells Located on the Southwest comer of Wells Road and State Route 25 in Peconic SCTM#1000-86-1-10.9 Zoning District: R-80 This proposal is for an 80/60 clustered conservation subdivision on 32.83 acres of land. Lot 1 equals 65,562 sq. ft., Lot 2 equals 77,694 sq. ft., and Lot 3 equals 29.5416 acres and is proposed to be preserved through a Sale of Development Rights to the Town of Southold. The parcel is located directly south of State Route 25; a designated New York State Scenic Byway. The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided to this department, as well as the records available to me, it is my recommendation that the proposed action is CONSISTENT with the Policy Standards and therefore is CONSISTENT with the LWRP provided the following recommendations are implemented on the proposed residential lots: To further Policy 3. Enhance visual quality and protect scenic resources throughout the Town of Southold E. Preserve existing vegetation and establish new indigenous vegetation to enhance scenic quality: 1. Preserve existing vegetation which contributes to the scenic quality of the landscape, and 4. Restore or add indigenous vegetative cover that presents a natural appearance. It is recommended that the Board through covenant and restriction: 1. Require that the existing trees along Wells Road remain to satisfy the intent of the street tree requirements and secondly, to maintain a vegetative buffer between the road and potential new homes. 2. Require the use of indigenous vegetative species in landscaping. To further policy 5.1. Prohibit direct or indirect discharges that would cause or contribute to contravention of water quality standards; and 5.4 Limit the potential for adverse impacts of watershed development on water quality and quantity. A. Protect water quality by ensuring that proposed expansion or intensification of existing watershed development results in: 1. protection of areas that provide important water quality benefits 2. maintenance of natural characteristics of drainage systems, and B. Limit the individual impacts associated with development to prevent cumulative water quality impacts which would lead to a failure to meet water quality standards. 5.5. Protect and conserve the quality and quantity of potable water. A. Prevent contamination of potable waters by limiting discharges of pollutants to maintain water quality according to water quality classification, and limiting, discouraging or prohibiting land use practices that are likely to contribute to contravention of surface and groundwater quality classifications for potable water supplies; and It is recommended that the Board require through covenant and restriction: 1. Require that driveways serving the proposed residential lots be constructed of pervious materials. 2. Prohibit the use of synthetic herbicides, pesticides and fertilizers on the parcel. Pursuant to Chapter 268, the Board shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. The file is available at your convenience. Description This is a 3 lot conservation subdivision located at the comer of Wells Road and Main Road (SR25) in Peconic. The total area of the property is 32.83 acres. The Town of Southold is in contract with the applicant to purchase the Development Rights on 29.5416 acres. The contract has a subdivision contingency stating that agreement is contingent upon seller receiving approval for creation ora 2-lot residential subdivision from the 2.83 acre area not included in the Sale/Purchase of Development Rights. Note: Richmond Creek and it's associated wetlands are immediately to the east, (across Wells Road) of the two proposed residential lots. Thank you for your cooperation. Tamara Sadoo Planner
