The meeting began at 7:06 p.m. with five LPC members present. Adoption of Meeting Minutes: ?? Acceptance of meeting minutes from April 28, 2009 MOTION made by Maureen Cullinane, seconded by Chris Baiz, to adopt the April 29, 2009 Land Preservation Committee meeting minutes. Motion carried: 5/0 Applications and Inquiries: ?? SUFFOLK COUNTY (Park & Playground in Rosewood Estates) SCTM #: 1000-113-2-24 Zoned: R-40 Location: 1300 Rosewood Dr, Mattituck CPF: No Total Acreage: RPS 1.16; GIS 1.06 Subdividable: NP FWet/MWet: 0 Status update. Town Board not interested in preserving this small parcel offered by County for a minimal purchase price. Melissa contacted neighbors that are interested in acquiring the property; however, County will need to follow through with their land sale requirements and property will need to be appraised and auctioned off. ?? BIGGANE PROPERTY SCTM #: 1000-95-1-11.2 PDR Acreage: ±17.7acres Location: 8865 Oregon Rd, Cutchogue Zoned: A-C Total Acreage: ± 19.7 Subdividable: Yes CPF: Yes Reviewed status of offer and Landowner’s appraisal [executive session] The members entered into EXECUTIVE SESSION. Landowner’s counter-offer was discussed. Melissa Spiro instructed to inform landowner that Committee, although favorable to preservation of this parcel, is not interested in landowner’s counter- offer. LPC believes that in today’s market, an update of the Town’s appraisal will decrease the land’s value and therefore, not meet the expectations of the landowner. END OF EXECUTIVE SESSION ?? MANOR GROVE PROPERTY SCTM # 1000-53-1-1.2 Zoned: R-80/LB (3.39 acres) Location: 68775 Route 25, Greenport CPF: Yes Total Acreage: 10.38 acres (GIS) Subdividable: Yes FWet: 6.65 acres SCTM # 1000-53-1-1.3 Zoned: R-80/LB (0.79 acre) Location: 650 Albertson La, Greenport CPF: Yes Total Acreage: 19.1 acres (GIS) Subdividable: Yes FWet: 10.66 acres Status update and update re: proposed restrictions on lot. Project is moving along slowly. Contract has been generated but not signed by landowners due to unresolved family issues. TNC expects to enter into contract with landowner and then subdivide land to create lot for the existing dwelling; TNC will then sell lot on the open market and sell open space to Town and County. A draft of proposed covenants & restrictions on the subdivision residential parcel is being reviewed by TNC. Adjacent motel encroachments are proposed to be remedied with a lot line change. General Land Preservation Items: ?? 2009 Farm & Ranch Lands Protection Program request for proposals Town received 2009 Federal Farm & Ranch Lands Protection Funds request for proposals. Melissa went over changes in FRPP Program. The list of current offer accepted farm projects was reviewed to see if any qualified for grant proposal. The Droskoski Estate Farm seems to best fit the application criteria. John Sepenoski left the room due to a family relationship to landowner and was not present for any further discussion on this agenda item. The members entered into EXECUTIVE SESSION. MOTION made by Ray Huntington, seconded by Lillian Ball, to direct Meilssa Spiro, to present to the Droskoski landowners an alternative to the existing offer and pending contract whereby Droskoski, in accepting all federal grant easement language and requirements including a restriction of up to 10% lot coverage, be offered a purchase price per buildable acre above the Committee’s previously offered purchase price subject to receiving grant award and landowners complying with all federal requirements. If acceptable to landowners, existing offer and pending contract to be revised reflecting federal easement language and grant requirements. If award not granted, terms of existing offer to remain as made by Committee in their motion presented and carried at its meeting on April 14, 2009. Motion carried: 4/0 (John Sepenoski absent from vote due to family relationship to landowner.) END OF EXECUTIVE SESSION ?? 2008 CPF audit Amended State Law regarding Peconic Bay Region Community Preservation Funds requires that each town conduct a yearly independent audit of CPF funds. Town of Southold’s audit prepared by George R. Rehn, CPA, has been completed, legal notice posted in Town’s official newspaper, and bulletin board, and is available for public review in the Town Clerk’s office or the Town’s website (www.southoldtown.northfork.net). A copy of the audit will be sent to the State Comptroller, pursuant to Town Law Chapter 62, Article 4. § 64-e (12). ?? MEMO FROM JENNIFER ANDALORO, ASST TOWN ATTY - LPC’s inquiry re: Custer Preserve Attorney’s memo distributed to committee members. The members re-entered into EXECUTIVE SESSION. ?? MELISSA SPIRO’S STATUS REPORT [executive session re: status of offers] Confidential status report distributed to committee members. END OF EXECUTIVE SESSION ?? FINANCIAL “LP SNAPSHOT” Ray Huntington distributed “RAINBOW” – CPF funding/borrowing scenario with projections to year 2030. Committee reviewed his charted report and instructed Melissa Spiro to request an appointment with the Town Board, and with Ray, to present RAINBOW for Town Board review. ?? STEWARDSHIP - Eagle Scout Project at Tall Pines Since no Management Plan is in place for Tall Pines, LPC recommends that Eagle Scout Project as presented in written form, be scaled down to exclude all trail work, kiosk and bench construction. LPC proposed that Eagle Scout 1) prepare an inventory of visual man-made materials and what to do with it; 2) supply Town with written list of said materials, location, and how items will be disposed of; 3) remove these man-made materials from Tall Pines; and 4) restore said areas to its natural state. ?? SUFFOLK COUNTY FARMLAND COMMITTEE MEETING MAY 26, 2009 AT 6:00 P.M. IN RIVERHEAD th Melissa made suggestion to cancel next LPC meeting scheduled for Tuesday, May 26 as she plans to attend Suffolk County Farmland Committee meeting. LPC favorable to canceling meeting; however, in the event that a project of significant importance comes up and cannot be discussed via e-mail, meeting may be re-scheduled. Next Regular Meeting: ?? The next regular meeting will be held on Tuesday, June 9, 2009, at 7:00 p.m., in the Town Hall Conference Room. Ray Huntington may not be able to attend this upcoming meeting. Adjournment: ??
