Box 1179 Southold, NY 11971 Telephone: 631 765-1938 Fax: 631 765-3136 Jim King, President Town of Southold Board of Trustees From: Scott Hilary and Mark Terry, LWRP Coordinators Date: August 13, 2008 Chapter 268, WATERFRONT CONSISTENCY REVIEW Wetland Permit for ELLIOT BRUCE & ORA JEAN HEATH SCTM#66-2-13 En-Consultants, Inc. on behalf of ELLIOT BRUCE & ORA JEAN HEATH requests a Wetland Permit to construct onto an existing two-story dwelling a northerly 9'X 13.8' two-story addition with a second-story balcony and 6.5'X 18.3' entry porch and steps in place of the existing one-story southerly portion of dwelling; construct onto northerly comer of dwelling a 6.5'X 8.5' patio with pergola; remove existing driveway and masonry walk and construct new stone walkway and pervious gravel driveway; install drainage system of drywells; and establish a 10' wide non-turf buffer on landward side of existing stone driveway located in existing access easement. Located: 500 Hippodrome Dr., Southold. SCTM#66-2-13 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is our recommendation that the proposed action is INCONSISTENT with LWRP policy standards and therefore is INCONSISTENT with the LWRP. 6.3 Protect and restore tidal and freshwater wetlands. A. Comply with statutory and regulatory requirements of the Southold Town Board of Trustees laws and regulations for all Andros Patent and other lan& under their jurisdiction 1. Comply with Trustee regulations and recommendations as set.forth in Trustee permit conditions. The distance from the tidal wetland to the proposed action is approximately 58 feetl a minimum setback distance of 100 feet from the wetland boundary is required pursuant to Chapter 275-3. No. 17-2005] (1) The following minimum setback~ apply to any and all operations proposed on residenlial property within the jurisdiction of the Board of Trustees: (a) Wetland boundary. [1] Residence: l OO feet. 'If the action is approved the following best management practice {BMP) is recommended: 1. Require the applicant to maximize a 20 foot perpetual non-turf pervious buffer. D. Provide adequate buffkrs between wet/an& and adjacent or nearby uses and activities in order to ensure protection of the wetland's character, quality, values, and functions. In the event the LWRP Coordinator's recommendation is that the action is inconsistent with the LWRP, and the agency makes a contrary determination of consistency, the agency shall elaborate in writing the basis for its disagreement with the recommendation and state the manner and extent to which the action is consistent with the L WRP policy standards. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. Town of So~thold ' A. A proposed action will be evaluated as to its significant beneficial and adverse effects upon the coastal area (which includes all of Southold Town). [ ¥es [--] Due to the Ioc~ation of the existing house and configuration of the parcel, it is impossible to situate the additions (or to move the house) more than 100 feet from wetlands, but the project will be consistent with Policy 6 due to the limited scope and location of the proposed additions, which except for the southerly porch and steps will be located over the existing house footprint or to the landward sides of the existing house footprint, and all additions will meet or exceed the existing wetlands setback. Consistency with Policy 6 is furthered via installation of a drainage system of drywells to reduce the volume of roof runoff and establishment of a planted nonturf buffer to reduce the volume and improve the quality of surface water runoff adjacent to Hippodrome Creek.
