Garrett A. Strang, Amhitect on behalf of PAUL BENTANCOURT requests a Wetland Permit to remove the existing steps to
beach and replace with a 3'6" X 45' stairway, one 5'4" X 6' top landing and one 3'6'X 3'4" intermediate landing, a min. 2' above
grade, and a Wetland Permit and Coastal Erosion Permit to remove and replace the decking surface and guardrails on the existing
deck using untreated lumber. Located: 1825 Aquaview Ave., East Marion. SCTM#22-2-6
The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and
the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP
Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that
the proposed actions (Walkway and Beach Steps) are CONSISTENT with LWRF policy standards and therefore is
CONSISTENT with the LWRP.
THE FOLLOWING SECTION ADDRESSES THE PROPOSED BEACH STEPS and WALKWAY:
Policy 6 Protect and restore the quality and function of the Town of Southold ecosystem.
6.3 Protect and restore tidal and freshwater wetlands.
The proposed beach steps and terraced walkway are permitted activities pursuant to § 111-14 provided that they are
constructed in accordance with the conditions of the coastal erosion permit and are further in compliance with § 275-11.
§ 111-14. Bluff area.
Bluf~ protect shorelands and coastal development by absorbing the often destructive energy of open water. Bluffs are a source of
depositional material,for beaches and other unconsolidated natural protective features.
B. Activities specifically allowed under this section are:
('3) New construction, modification or restoration of walkways or stairways done in accordance with conditions of a coastal
erosion management permit.
§ 275-11 Construction and operation standards.
Genera[. The fo/lowing standard~' are required for all operations within the jurisdiction of the Trustees:
(6) Decks and pla¢)rms. No decks or platfi~rms shall be permitted on or near bluff'. Pla¢)rms associated with stairs tnay not
be larger than 32 square feet. [Amended 10-11-2005 by L.L. No. 17-2005]

The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and
the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP
Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that
the proposed action is EXEMPT pursuant to § 268-3.
MINOR ACTIONS -- Include the following actions, which are not subject to review under this chapter:

and other ministerial permits not located within the Coastal Erosion Hazard Area.
Before answering the questions in Section C, the preparer of this form should review the exempt
minor action list, policies and explanations of each policy contained in the Town of Southold Local
Waterfront Revitalization Program. A proposed action will be evaluated as to its significant
beneficial and adverse effects upon the coastal area (which includes all of Southold Town).
If any question in Section C on this form is answered "yes" or "no", then the proposed action will
affect the achievement of the LWRP policy standards and conditions contained in the consistency
review law. Thus~ each answer must be explained in detail~ listing both supporting and non-
suooortin~ facts. If an action cannot be certified policy standards and
conditions, it shall not be undertaken.
