WITNESSETH, that the party of the first part, to whom letters
testamentary were issued by the Surrogate's Court, Suffolk County, New York
on Apr i 1 19 , 1995 and by virtue of the power and authority given in and by said last will
and testament, and/or by Article 11 of the Estates, Powers and Trusts Law, and in consideration of
TEN dollars,
paid by the party of the second part, does hereby grant and
release unto the party of the second part, the distributees or successors and assigns of the party of the second
part forever,
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate,

TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and
roads abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances,
and also all the estate which the said decedent had at the time of decedent's death in said premises, and also
the estate therein, which the party of the first part has or has power to conveyor dispose of, whether individ-
ually, or by virtue of said will or otherwise; TO HAVE AND TO HOLD the premises herein granted unto
the party of the second part, the distributees or successors and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything
whereby the said premises have been incumbered in any way whatever, except as aforesaid.
Subject to the trust fund provisions of section thirteen of the Lien Law.

SCHEDULE A
(DESCRIPTION OF PREMISES)
All that certain plot, piece or parcel of land, with the
buildings thereon erect, situate, lying and being at
Mattituck, in the Town of Southold, County of Suffolk, and
State of New York, being and bounded and described as follows :
BEGINNING at a monument, set in the Southerly line of lot 64,
as shown on a certain Map, entitled, "Amended Map of Mattituck
Heights, Property of Gustav Bayer, at Mattituck, Suffolk
County, New York, surveyed by Otto W. Van Tuyl, Greenport, New
York, on July 10th, 1935, " and filed in the Office of the
Clerk of the County of Suffolk on July 24, 1935, as Map No.
1184, where said Southerly line of Lot 64 on said Map is
intersected by the division line between Plot 'C' and Plot
'D' , as shown on the aforesaid Map; running thence North 31
degrees, 04 minutes, 30 seconds East along the Southerly line
of Lots, 64, 63, 62, and 61, as shown on said Map 123 .52 feet
to an iron pipe; thence North 75 degrees, 57 minutes and 10
seconds East, 35 feet to an iron pipe; thence South 19
degrees, 32 minutes and 50 seconds East crossing Farm Road
303 .40 feet to land now or formerly of Conklin; running thence
along said land now or formerly of Conklin, along the center
line of a gutter having a tie line South 59 degrees, 38
minutes and 20 seconds West 130 . 60 feet, to land now or
formerly of Comiskey; thence North 20 degrees, 00 minutes and
30 seconds West, along said land now or formerly of Comiskey,
and again crossing Farm Road and through a monument a distance
of 252 . 90 feet to the monument at the point or place of
beginning.
TOGETHER with the use of a right of way 8 feet wide to and
from Wickham Avenue to Long Creek, a branch of Mattituck Bay,
to pass and repass on foot only; said right of way commencing
at the Northerly junction of Middle Road and Wickham Avenue,
at a concrete monument, running in a Westerly direction 8
feet; thence running in a Northerly direction 130 feet
parallel with the boundary line of property of Hubert W. Klein
and Gustav Bayer, to mean high water mark of Long Creek;
thence running in an Easterly direction along Long Creek to
land of Hubert Klein; then running in a Southerly direction,
along the Westerly boundary of property of Hubert W. Klein,
130 feet, to a concrete monument, the Northerly junction of
Middle Road and Wickham Avenue, the point or place of
beginning.
TOGETHER with the use of a right of way, known as Farm Road,
to pass and repass from Grand Boulevard to Wickham Avenue.
TOGETHER with all the right, title and interest, if any, of
the party of the first part in and to any land lying in front
