In part, the variance decision reads, "(3) a new two-story extension and trellis, both located at the south side of the dwelling 31 '7" (minimum) from the front lot line adjacent to New Suffolk Avenue, all shown on the 6-6-05 site map and Plans A. 1, A.2, A.3, A.3-1, prepared by Architecnolo gies." PROPERTY FACTS/DESCRIPTION: The applicant's 20,122 square foot parcel has 100 feet along Grathwohl Road and 172.98 feet along new Suffolk Avenue in Cutchogue. The lot is improved with a single- family, one-story dwelling and small metal shed, as shown on the 6-6-05 site map prepared by Architechnologies (using data from a 10-27-04 survey prepared by John C. Ehlers). BASIS OF APPLICATION: Code Section 100-242A (Walz Interpretation No. 5039) and 100-244, based on the Building Inspector's March 13, 2006 Notice of Disapproval concerning removal of the first floor of the existing dwelling and reconstruction. The recent first-floor reconstruction was found to be beyond the scope of the building permit requested and granted on August 9, 2005 (31715-Z) and variance requested and granted under Appeal No. 5757 concerning a second-story addition over the existing first floor, at less than 40 feet from the front yard line and less than 50 feet from the rear yard line. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on April 27, 2006, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: AREA VARIANCE RELIEF REQUESTED: The applicant is requesting an amendment to the prior variance and building permit to allow for reconstruction of the dwelling, rather than building a second-floor addition over the existing first floor. REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: 1. Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The proposed unauthorized reconstruction, after demolition of the nonconforming wall facing the front property line, will be within the same setbacks without change according to the September 1,2005 ZBA Decision under Application No. 5747. Page 2 - May 11, 2006 ZB File No. 5877- Rose Hajek CTM No. 117-5-15 2. The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The applicant's house, prior to the commencement of the recent reconstruction, was a single-story ranch and was the smallest house in the area. The houses on both sides and to the rear are 2-1/2 story, single-family homes. 3. The variance granted herein is not substantial and although construction has been modified from the original building permit and variance requested in August 2005, the amended construction areas will maintain the same setbacks as approved for the second-story addition over the existing first floor of the home, with a reduction in the front yard setback at less than one foot. Also, no change is proposed to the prior approved addition are the rear of the home (in the area of the existing ground-level concrete patio). 4. The difficulty has been self-created 5. No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. 6. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of reconstruction of the existing home in the same footprint, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Simon, seconded by Member Goehringer, and duly carried, to GRANT the variance as applied for, as shown on the Demolition Plan dated March 20, 2006 prepared by Architechnologies. Any deviation from the variance given such as extensions, or demolitions which am not shown on the applicant's diagrams or survey site maps, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. BASIS OF APPLICATION: Building Department's June 11, 2005 Notice of Disapproval, citing Section 100-242A and 100-244, in its denial of an application for a building permit to construct additions and alterations to an existing d~velling. The reason stated for disapproving the application is the new construction will increase the degree of nonconformance when located at less than 40 feet from the front lot line and less than 50 feet from the rear lot line. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on August 18, 2005 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: AREA VARIANCE RELIEF REQUESTI~B: The applicants wish to construct: (1) a proposed second story addition over the existing first floor at 36+- feet from the southerly lot line and 43'3" from the northerly lot line, (2) a new sunroom 37'9" from the northerly property line, (3) a new two-story extension and trellis, both located at the south side of the dwelling 31'7" (minimum) from the front lot line adjacent to New Suffolk Avenue, ail as shown on the 6-6-05 site map and Plans A.1, A.2, A.3, A.3-1, prepared by Architecnologies. REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: P, age 2 - September 1, 2005 ZB File Ref, 5747 - Rose Hajek CTM 117-6-15 1. Grant of the variances will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The applicant's house is one-story ranch and is the smallest house in the area. The houses on both sides and to the rear are all 2-1/2 story homes. 2. The benefit sought by the applicant for enlargement of living space utilizes most of the existing first floor area of the home and cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. 3. The variances granted are not substantial. The increase in the degree of the existing nonconforming setback for the front setback is less than one foot. The addition to the rear will not extend beyond the requested setback of 37'9", which location is presently occupied as a ground-level concrete patio. 4. The difficulty has been self-created since portions of the additions will extend within the nonconforming setback area of the existing dwelling. 5. No evidence has been submitted to suggest that the requested variances in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. 6. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of additions and alterations, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Simon, seconded by Chair~voman Oliva, and duly carried, to GRANT the variances as applied for, as shown on the 6-6-05 site map and Plans A.1, A.2, A.3, A.3-1, prepared by Architecnologies. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. Vote of the Board: Ayes: Members Oliva (Chait~voman), Orlando, Dinizio, and Simon. Goehringer was absent.) This Resolution was du .ado ed . The existing single family dwelling notes an existing front yard setback of 32.5 feet and an exsiting rear yard setback of 43.3 feet. Following the proposed additions and alterations, the dwelling will have a front yard setback 31.7 feet and a rear yard setback of 37.9 feet. Pursuant to the ZBA's interpretation in Walz (#5309), such additions and alterations will thus constitute an increase in the degree of nonconformance. Pursuant to Article XXVI, Section 100-244, parcels measuring between 20,000 and 39,999 square feet in total size, require a minimum front yard setback of 40 feet and a minimum rear yard setback of 50 feet.
