This may be from improper grading around the foundation which is now allowing water to pond adjacent to the foundation. It may also be coming from groundwater coming up through the slab. I would recommend that the extedor grading be done in accordance with building code R401.3 which requiresa positive grade of 6 inches for 10 feet from the foundation. Because of the possible high ground water you should install a sump pump in that comer of the basement to limit future water entry. The builder converted the garage area to living space. According to plans you obtained from the Building Department, that area became a crawl space with a 2 inch screed coatof concrete and a 24" x 36" access to the crawl space. Please note found the following: a. The access to the crawl space was not installed b. There is no venting to that space without the access c. There would be no way to install insulation to that space after framing d. We do not know if the builder installed the 2" screed coat as required. It is required that the builder install the access. The applicant is proposing installing the sanitary system less than 150 feet from a private well. Residential construction standards require that a subsurface sewage disposal system be placed at least five feet from a property line. The applicant is proposing a septic system to serve a single-family dwelling that does not conform to departmental standards in that portions of the system are located within five feet ora property line. Findings and Facts 1. The applicant is proposing to construct a single-family residence using an on-site sewage disposal system and public water on a lot with an area of 10,094 square feet (sO. 2. The project is located in Groundwater Management Zone 4. 3. Soil conditions are good with sand and gravel at 2.5 feet below current grade. 4. Depth to groundwater is 10.5 feet below existing grade. 5. Water service will be public water supplied by Suffolk County Water Authority (SCWA). The location of the new sewage disposal system is constrained by existing site conditions including a presumed shallow drinking water well on the lot to the west (Voneiff) and a "dredged canal" to the north. The proposed sewage disposal system consists of a 1,000 gallon septic tank and two 8-foot · by 6 feet deep leaching pools with area for expansion as required by the department's construction standards. The pools are proposed to be placed three feet above groundwater. Brian L. No data is available on the Voneiff well but it is assumed shallow because the department has data fi.om nearby wells that indicates that deep wells will not conform to drinking water standards due to high chlorides fi.om salt water intrusion. 10. The applicant has made an offer to connect the Voneiff dwelling to the newly installed public water main but has received no response. 11. Direction of groundwater flow is assumed north toward the canal and Long Island Sound. The direction of gronndwater flow is lateral to the Voneiffwell. 12. The placement of the disposal system is directly below an overhead power line. There are guy wires fi.om a utility pole located in the area where the leaching pools are proposed that could also interfere with proper placement of the disposal system. The applicant is proposing to move the utility pole to a new location. 13. The applicant maintains that the edge of the leaching pools have been placed on the property line due to the town request to maximize the distance to wetlands. No letter from the town was submitted. 14. The applicant possesses a letter of non-jurisdiction fi.om the New York State Department of Environmental Conservation (NYSDEC) and a Town of Southold wetlands permit. Determination It was a 3 to 0 determination of the Board to grant the request for the variance, provided the following conditions are met: The applicant shall submit a letter to the department signed by a responsible Southold Town official, consenting to the placement of the leaching pools so that the edge of the leaching pools are directly on the front property line, which de£mes the border between the applicant's property and town-owned property. If the applicant fails to produce a letter, then the leaching pool locations (including expansion area) shall each be moved 5 feet to the north so that minimum separation distance to property lines as required by standards can be maintained. drian L.
