party of the second part,
WITNESSETH, that the party of the first part, in consideration of len dollars and other valuable consideration
paid by the party of the second part, does hereby grant and release unto the party of the second part, the heirs
or successors and assigns of the party of the second part forever,
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate,
lying and beingiat1w at Cutchogue, Town of Southold, County of Suffolk, and State of
New York, known and designated as Lot 117 on a certain map entitled "Map of the
Wuudr; aL CuLclwgue:," filed in the Office of "he Clerk of the County of Suffolk
on 3/23/89 as Map 118717, which lot is more particularly bounded and described as
follows:
BEGINNING at a point on the southeasterly side of Evergreen Drive said point
beingwhere the division line of Lots 7 and 8 intersect the southeasterly line
of Evergreen Drive;
RUNNING THENCE in a northeasterly direction along the southeasterly side of
Evergreen Drive along an arc of a curve to the left, said curve having a radius
of 50 feet and a length of 54.53 feet to a point;
THENCE South 81 degrees 27 Minutes 40 Seconds East, 292.83 feet to a point;
THENCE South 41 degrees 20 Minutes 40 Seconds West, 350.00 feet to a point;
THENCE North 18 degrees 58 Minutes 10 Seconds West, 281.68 feet to a point
on the southeasterly side of Evergreen Drive the point or place of BEGINNING.
BEING AND INTENDED TO BE part of the same premises as conveyed to the party of
the first part by deed dated 8/11/93 and recorded in the Office of the Clerk
of the County of Suffolk in Liber 11642 of Conveyances at Page 109 on 8/31/93.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and
roads abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances
and all the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO
HOLD the premises herein granted unto the party of the second part, the heirs or successors and assigns of
the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything
whereby the said premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of
the first part will receive the consideration for this conveyance and will hold the right to receive such consid-
eration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply
the same first to the payment of the cost of the improvement before using any part of the total of the same for
any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenlpre so requires.
