Moore, Esq. on behalf of MARIA TRUPIA requests a Wetland Permit to construct a 4'X 55' catwalk using "Flo-thru" decking, 4" posts in the marsh and 6" piles in the water, and with steps to grade; and install an in-ground swimming pool. Located: 1395 Sleepy Hollow Lane, Southold. SCTM#78-1 - 10.20 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action (POOL see figure #1) is CONSISTENT with LWRP policy standards and therefore is CONSISTENT with the LWRP; provided that the proposed pool and related structures are placed at a minimum setback of 50 feet from the wetland boundary pursuant to § 275-3. THE FOLLOWING SECTION ADDRESSES THE PROPOSED POOL: Policy 6. Protect and restore the quality and function of the Town of Southold ecosystem. 6.3 Protect and restore tidal and freshwater wetlands. Comply with statutory and regulatory requirements of the SouthoM Town Board of Trustees laws and regulations for all Andros Patent and other lands under their jurisdiction 1. Comply with Trustee regulations and recommendations as set forth in Trustee permit conditions. § 275-3 Findings; purpose; jurisdiction; setbacks. D. Setbacks. [Amended 10-11-2005 by L.L. No. 17-2005] The following minimum setbacks apply to any and all operations proposed on residential property within the jurisdiction of the Board of Trustees: (a) V~etland boundary. The proposed action is located in Goose Creek a Critical Environmental Area nominated by the Town of Southold as worthy of protection (see Critical Environmental Areas § 275-2 Definitions below). Any proposed action in a Critical Environmental Area may be subiect to more stringent requirements such as denial of certaln operations pursuant to § 275-11 Construction and operation standards. § 275-2 Definitions; word usage. CRITICAL ENVIRONMENTAL AREAS -- All sites previously nominated by the Town t?/'Southold and designated by the New York Sate Department of slate as Critical Environmental Areas worl½(y c~f protection including: Cutchogue Harbor Wetlan&, Hallock's Bay, Dam Pond, Downs Creek, Orient Creek, West Creek, Richmond Creek and Beach, Brush's ('reek, Cedar Beach Creek, Corey Creek, Deet~ Hole Creek, GoMs'miths Inlet, Halls ('reek, Goose Creek, Little Creek. Mill Creek and Pipes Cove ('reek. § 275-11 Construction and operation standards. (7) Critical environmental areas. Al the discretion (4f lhe Board (~' 7kustees, any operalions proposed in critical environmental areas (§ 275-2) may be subject to more stringent requirements' than detailed in this section. Such requirements muy include~ but are not limited to, denial of certain operations, shortenb~g or reducing the size qf structures, and increasing the width q]:'nondisturbance buffers'. Policy 6 Protect and restore the quality and function of the Town of Southold ecosystem. 6.3 Protect and restore tidal and freshwater wetlands. Comply with statutory and regulatory requirements of the SouthoM Town Board of Trustees laws and regulations for all Andros Patent and other lands under their jurisdiction 1. Comply with Trustee regulations and recommendations as set forth in Trustee permit conditions. The applicant must demonstrate that the following dock standards pursuant to § 275-11 Construction and operation standards have been met. § 275-11 Construction and operation standards. C. In water. The following standards are required for all in-water operations adjacent to residential properties. Operations conducted on properties zoned MI or M2 may be given greater flexibility in these requirements given the water- dependent nature of their use. (2) Docks. Review and approval of dock applications. Before issuing a permit for a dock structure, the Trustees shall consider whether the dock will have any of the following harmful effects: I~hether the dock will impair navigation or be located in areas of high vessel traffic or vessel congestion; I~ether the dock will unduly interfere with the public use of waterways for swimming, boating, fishing, shellfishing, watersMing and other water-dependant activHies; Whether the dock will unduly interfere with transit by the public along the public beaches or foreshore; ~hether the dock will significantly impair the use or value of waterfront property adjacent to or near the dock; ~hether the dock will cause degradation of surface water quality and natural resources: l~/hether the dock will cause habitat fragmentation and loss of significant coastal fish and wildlife habitats; The proposed actions if approved will result in habitat destruction and impairment with the physical loss of significant fish and wildlife habitat within a Critical Environmental Area. If the dock is constructed the loss /7/ of high and Iow intertidal marsh habitats will occur. The proposed action and associated impacts could be mitigated by seasonally mooring a vessel in public waters. This alternative would lessen the potential impacts to the high and Iow intertidal marsh habitat within Goose Creek. Whether the dock will result in the destruction of or prevent the growth of vegetated wetlands, seagrasses including eelgrass (Zostera marina) and widgeon grass (Ruppia maritima) or shellfish; The proposed dock and wood chip path will result in the destruction of or prevent the growth of vegetated wetlands. Whether the dock will unduly restrict tidal flow or water circulation; I'Fhether the dock will be safe when constructed; Whether the dock will adversely affect views, viewsheds and vistas important to the community; Whether the cumulative impacts of a residential and commercial dock will change the waterway or the environment and whether alternate design, construction, and location of the dock will minimize cumulative impacts; and Whether adequate facilities are available to boat owners and/or operators for fueling, discharge of waste and rubbish, electrical service and water service. Policy 6 Protect and restore the quality and function of the Town of Southold ecosystem. 6.1 Protect and restore ecological quality throughout the Town of Southold. B. Protect and restore ecological quality by adhering to the./bllo~,ing measures. 3. Avoid fragmentation of ecological communities' and maintain corridom to facilitate the free exchange of biological resources within and among communities. a. Each individual resource area should be maintained as complete contiguous areas to protect the area's natural resource values. Spec!/ically, actions that ~4,ould fragment the ecological community into separate ecological islands should be avoided. b. Where jhagmentation (?f ecological communities has already occurred, the adverse effects e[i~'agment~tion can be tnitigated by maintaining or providing connecting corridors to allow exchange of biological resources. The fragmentation of habitat can be avoided through other public land access alternatives such as vessel moorings. The action, as proposed~ will result in the continued fragmentation ora Critical Environmental Area. If approved, the proposed action will result in the continued physical loss of the ecological sensitive area of Goose Creek. Policy 9-Provide for public access to, and recreational use of, coastal waters, public lands, and public resources of the Town of Southold. The proposed action is private, noncommercial and will not support a pattern of development that enhances community character nor preserves "Public" access or public recreational activities Policy Standard-9.4 Assure public access to public trust lands and navigable waters. A mooring in an area with appropriate water depth is an alternative and would further LWRP Policy 9 above. (vi~ whether or not alternative means to gain access are available. The applicant currently enioys unrestricted access to Goose Creek through an established walking path (see figure #2 below) pursuant to § 275-2. The applicant also has an alternate means of access to Goose Creek via the Town's boat ramp off Gagen's Landing Rd. (see figure # 4 attached). § 275-2 Definitions; word usage. Review of actions. In the event the LWRP Coordinator's recommendation is that the action is inconsistent with the LI4ZRP, and the agency makes a contrary determination of consistency, the agentT shall elaborate in writing the basis ,/bt ils disagreement with the recommendation and state the manner and extent to which the action is consistent with the L WRP policy standards. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. The permitted walkway is intended to provide access to the water only. This permit does not authorize the installation of a ramp or a float or pilings or a pulley system or other type of boat mooring device. The issuance of this permit should not be construed to suggest that a permit will be issued for boat mooring facilities in the future. 2. Any debris or excess material from construction of this project shall be completely removed from the adjacent area and removed to an approved upland area for disposal. No debris is permitted in tidal wetlands or protected buffer areas. 3. The storage of construction equipment and materials shall be confined within the project work area and/or upland areas greater than 75 linear feet from the tidal wetland boundary. 4. The timber catwalk shall not exceed 4 feet in width and shall be a minimum of 2 above grade over tidal wetland areas (*as measured from ground to the bottom of the dock/catwalk decking). 5. The use of wood li'eated with pentachlorophenol or other wood treatment not specifically approved by the Department for use in wetlands and/or marine waters, is strictly prohibited in the construction of structures that will be in contact with tidal waters. 6.
