Chapter 268: Waterfront Consistency Review
Wetland Permit for IAN & AMANDA MORRIS

IAN & AMANDA MORRIS request a Wetland Permit & Coastal Erosion Permit for the pre-
existing 16.8'X 17.8' attached deck; pre-existing 11.3' X 14.4' deck; and pre-existing timber
stairs and platforms on the bluff. Located: 1595 Aquaview Ave., East Marion. SCTM#22-2-4
The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the
Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy
Standards. Based upon the information provided on the LWRP Consistency Assessment Form
submitted to this department, as well as the records available to me, it is my recommendation that
the proposed action is INCONSISTENT with the following LWRP policy standards and
therefore is INCONSISTENT with the LWRP.
Policy 6 Protect and restore the quality and function of the Town of Southold
ecosystem.
6.3 Protect and restore tidal and freshwater wetlands.
A. General. The following standards are required for all operations within the jurisdiction
of the Trustees:
Comply with statutory and regulatory requirements' of the Southold Town Board of
Trustees laws and regulations for all Andros Patent and other lands under their
jurisdiction
The pre-existing structures (deck and platforms) are not in compliance with the § 275-11
Construction and operation standards. The deck 16.8' X 17.8' is not permitted on or near
the bluff and the two platforms associated with the stairs are more than 32 square feet each.
§ 275-11 Construction and operation standards.
(6) Decks and platforms. No decks or platforms shall be permitted on or near
bluffs'. Platforms associated with stairs may not be larger than 32 square feet.

Dear Mr. King:
As I was advised by Lauren Standish in response to my letter to you dated 2 April 2008, please find
enclosed Wetlands and Coastal Erosion Permit Applications requesting that the Board formally permit
several legally preexisting structures, including a 16.8' x 17.8 attached deck; 11.3' x 14.4' detached deck;
and adjoining timber stairs and platforms down the bluffto the beach, all of which are located within 100
feet of Long Island Sound, seaward of the top of bluff, and within the Coastal Erosion Hazard Area, all as
depicted on the enclosed survey prepared by Stanley Isaksen, Jr., last dated March 19, 2008.
As evidenced by the attached 1) sworn alTidavit from the prior owners, Robert and Doris Anfig, testifying
that the deck was in place at the time of their purchase on April 1, 1971; and 2) aerial photograph by
AeroGmphics, which depicts the presence of the deck on March 24, 1976, these structures were
constructed prior to 1971 and therefore prior to the permit requirements of Chapters 275 (previously 97)
and 111 (previously 37) of the Town Code, which granted the Board of Trustees jurisdiction over lands
adjacent to Long Island Sound and the Coastal Erosion Hazard Area in 1983 and 1991, respectively.
Please note that because we are not requesting permission to replace or reconstruct these slxuctures, there
are no current construction projects or other physical activities proposed by these applications. Therefore,
the formal permitting of these structures pursuant to Chapters~f the Town Code docs not
