part, in consideration of Ten Dollars and other valuable consideration
paid by the partyuf the second part,does hereby grant and release unto the party of the second part, the heirs
ALL that certain plot, piece or parcel of land, situate, lying and being at Mattituck,
Town of Southold, County of Suffolk and State of New York, bounded and
dedescribed as Vllows:
BEGINNING at a concrete monument set at the intersection of the westerly line of
Deer Path Road (Private Road) and the southerly line of a private road, known as
Miller's (Bungalow Lane) Road (Miller's Right of Way) right which said point of
beginning is South 85 degrees 15 minutes East, a distance of 1439.11 feet from the
point of intersection of the easterly line of Cox Neck Road (Mill Road) and the
southerly line of said private road, known as Miller's Road (Bungalow Lane) Road
(Miller's Right of Way), from said point of beginning;
RUNNING THENCE South 22 degrees 30 minutes East along the westerly line of said
Deer Path Road (Private Road), a distance of 129.50 feet to a concrete monument and
lands now or formerly of W.H: Wertenberg;
THENCE South 67 degrees 30 minutes West, 140.0 feet to a concrete monument and
land now or formerly of G. & V. Frey;
THENCE North 22 degrees 50 minutes West, 200.84 feet through a concrete
monument to a concrete monument set in the southerly line of Miller's (Bungalow
Lane) Road (Miller's Right of Way);
THENCE South 85 degrees 30 minutes East, 157.13 feet along the southerly line of
said private road known.as Miller's (Bungalow Lane) Road (Miller's Right of Way) at
the point or place of BEGINNING.
SAID premises also known as 100 Deer Path, Mattituck, NY. Being and intended to
be the same premises conveyed to George Weinreich and Marie Weinreich, as tenants
in common by deed dated x/17/94 recorded 7/17/94 in Liber 11685 cp 327.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and
roads abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances
and all the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO
HOLD the premises herein granted unto the party of the second part, the heirs or successors and assigns of
the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything
whereby the said premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Sectigr 13 of the Lien Law, covenants that the party of
the first part will receive the consideration for this conveyance and will hold the right to receive such consid-
eration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply
the same first to the payment of the cost of the improvement before using any part of the total of the same for
any other purpose:
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
