Chapter 268: Waterfront Consistency Review
Wetland Permit and Coastal Erosion Permit for STEVEN & SEVGI UYANIK
SCTM# 44-1-6
Costello Marine Contracting Corp. on behalf of STEVEN & SEVGI UYANIK request a
Wetland Permit & Coastal Erosion Permit to remove partial remains of existing bulkhead. Re-
grade existing bank to top of bluff. Construct 88' of new bulkhead in place; 8' return on west end
and 16' return on east end. Remove all existing rocks encountered during construction and
replace as armoring at base of new bulkhead upon completion. Remove existing platform and
stairway to beach. Construct new 10'X 16' upper deck; 10'X 12' lower deck and 3' wide
stairways to beach in new location. Provide 10' wide non-turf buffer zone behind new bulkhead.
Re-vegetate with Cape American Beach grass. Install erosion control geometric design nylon
matting "Enkamat" 7010 or equal from base of bluff to top of bluff and re-vegetate slope with a
combination of Bayberry, Rosa Virginia and Beach Plum plantings. Located: 55055 North Rd.,
Southold. SCTM#44-1-6
The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the
Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy
Standards. Based upon the information provided on the LWRP Consistency Assessment Form
submitted to this department, as well as the records available to me, it is my recommendation that
the proposed action is INCONSISTENT with the following LWRP policy standards and
therefore is INCONSISTENT with the LWRP.
Policy 6 Protect and restore the quality and function of the Town of Southold
ecosystem.
6.3 Protect and restore tidal and freshwater wetlands.
A. General. The following standards are required for all operations within the jurisdiction
of the Trustees:
Comply with statutory and regulatory requirements of the $outhold Town Board of
Trustees laws and regulations for all Andros Patent and other lands under their
jurisdiction
The proposed action is not in compliance with the following § 275 standards as per proiect
description, (Construct new 10' x 16' upper deck and 10' x 12' lower deck).
§ 275-11 Construction and operation standards.
A. General. The following standards are required for all operations within the jurisdiction
of the Trustees:
Decks and platforms. No decks or platforms shall be permitted on or near
bluffs. Platforms associated with stairs may not be larger than 32 square feet
The proposed action is not in compliance with the following § 111 standards as per proiect
description~ {Remove all existing rocks encountered during construction and replace as
armoring at base of new bulkhead upon completion) and (re-grade existing bank to top of
bluff}.
§ 111-12 Beach area.
Beaches buffer shorelands from erosion by absorbing wave energy that otherwise would be
expended on the toes of bluffs or dunes. Beaches that are high and wide protect shorelands from
erosion more effectively than beaches that are low or narrow. Beaches also act as reservoirs of
sand or other unconsolidated material for longshore littoral transport and offshore sandbar and
shoal formation. The following restrictions apply to regulated activities in beach areas:
Excavating, grading or mining which diminishes the erosion protection afforded by
beaches is prohibited.

use of a coastal location, and minimizes adverse effects of development.
This is a waterfront piece of property that is presently bulkheaded. The bulkhead is failing and needs
to be reconstructed. The stairs will allow the property owner to access the water. Our proposal is an
effort to maintain existing structures and the integrity of the bluff. The construction will be landward
of the high water mark and the majority will be on the bluff.

Preserve historic resources of the Town of Southold,
This property has no significant historic resources.

Enhance visual quality and protect scenic resources throughout the Town of Southold.
The bulkhead at this location is existing. The present condition of this bulkhead is showing its age by
reconstructing the bulkhead will lend itself to a new structures versus a run down, unmaintained
structure. In addition, any additional rock uncovered on the property will be placed in front of the
bulkhead. This will help in dispersing the wave action but also is more aesthetically pleasing. This
entire shoreline is bulkhead so the visual quality and scenic resources will remain the same.
NATURAL COAST POLZCIES
Policy 4 Minimize loss of life, structures, and natural resources from flooding and erosion.
The existing bulkhead is needed to protect the upland property. This shoreline is mostly reinforced
with erosion control structures. The new bulkhead will not increase flooding or erosion in this area.

Southold. There is a bulkhead presently existing and we are proposing for in-place construction. All
structures are landward of the AHWM.

dependent uses in suitable locations.
Our proposal is to reconstruct a failing bulkhead. The present condition of the bulkhead is poor and
is unsafe. The construction of a new bulkhead in its place will allow the property owners to safely
access the water.
