Request for Wetland Permit for LE~VIS TOPPER
SCTM#123-6-13
Catherine Mesiano, Inc. on behalf of LEWIS TOPPER requests a Wetland Permit to demolish
the existing 31 'X 49' frame house located 15' north of the existing bulkhead and construct a new
15'X 60' two-story dwelling 40' north of the bulkhead; relocate and renovate the 18'X 37'
accessory structure presently location 126' north of the bulkhead to 154' north of the bulkhead;
abandon the existing septic system and install a new sanitary system 125' from the bulkhead and
125' from AHW; install drywells for containment of stormwater run-off, and create a 10' non-turf
buffer. Located: 3605 Camp Mineola Rd., Mattituck. SCTM#123-6-13
The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the
Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy
Standards. Based upon the information provided on the LWRP Consistency Assessment Form
submitted to this department, as well as the records available to me, it is my recommendation that
the proposed action is INCONSISTENT with the denoted following Policy Standards and
therefore is INCONSISTENT with the LWRP.
The proposed action is located in an AE Elevation 8 flood zone.
4.1 Minimize losses of human life and structures from flooding and erosion hazards.
The following management measures to minimize losses of human life and structures
from flooding and erosion hazards are suggested:
Move existing development and structures as far away from
flooding and erosion hazards as practical. Maintaining existing
development and structures in hazard areas may be warranted for:
structures which functionally require a location on the coast
or in coastal waters.
water-dependent uses which cannot avoid exposure to
hazards.
sites in areas with extensive public investment, public
infrastructure, or major public facilities.
sites where relocation of an existing structure is not
practical.
The proposed use is residential and does not meet the required
criteria above and is not a "water dependent use". Due to the depth
of the lot {630.87')~ there is ability to site the residential structure
further away from the flooding hazards~ maximize the distance from
the "hazard area" and minimize the potential of future structural
loss.
Policy 6. Protect and restore the quality and function of the Town of Southold ecosystem.
6.3 Protect and restore tidal and freshwater wetlands.
Comply with statutory and regulatory requirements of the SouthoM Town Board of
Trustees laws and regulations for all Andros Patent and other lands under their
jurisdiction
1. Comply with Trustee regulations and recommendations as set forth in
Trustee permit conditions.
The distance from the proposed residence is 40 feet from the top-of-bulkhead; a
minimum setback distance of 100 feet is required pursuant to Chapter 275-3.

Please require that the applicant amend the application to meet the above policy
to the greatest extent practicable.
If the action is approved and to further Policy 5: Protect and Improve Water quality in the
Town of Southold it is recommended that the Board.

LWRP CONSISTENCY ASSESSMENT FORM
A. INSTRUCTIONS
1. All applicants for permits* including Town of Southold agencies, shall complete this CCAF for
proposed actions that are subject to the Town of Southold Waterfront Consistency Review Law.
This assessment is intended to supplement other information used by a Town of Southold agency
in making a determination of consistency. *Except minor exempt actions including Building
Permit and other ministerial permits not located within the Coastal Erosion Hazard~4rea
2. Before answering the questions in Section C, the preparer of this form should review the
exempt minor action list, policies and explanations of each policy contained in the Town of
Southold Local Waterfront Revitalization Program. A proposed action will be evaluated as to its
significant beneficial and adverse effects upon the coastal area (which includes all of Southold
Town).
3. If any question in Section C on this form is answered "yes", then the proposed action may
affect the achievement of the LWRP policy standards and conditions contained in the consistency
review law. Thus, the action should be analyzed in more detail and, if necessary, modified prior
to making a determination that it is consistent to the maximum extent practicable with the LWRP
policy standards and conditions. If an action cannot be certified as consistent with the LWRP
policy standards and conditions, it shall not be undertaken.
A copy of the LWRP is available in the following places: online at the Town of Southold's
website (southoldtown.northfork.net), the Board of Trustees Office, the Planning Department, all
local libraries and the Town Clerk's office.
