This proposal is for a request for variances pursuant to the Building Inspector's November 3, 2008
Notice of Disapproval and Zoning Code Interpretation # 5039 ONalz Application), citing Code
Sections 280-112 and 280-124 for the minimum required side yard setbacks on nonconforming
lots (51,955 square feet in this R-80 Zone). The applicant is proposing a new dwelling at less
than 20 feet on a single side yard and less than 40 feet for total side yards.
The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the
Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy
Standards. Based upon the information provided on the LWRP Consistency Assessment Form
submitted to this department, as well as the records available to me, it is my recommendation that
the proposed action is CONSISTENT with the denoted following Policy Standards and therefore is
CONSISTENT with the LWRP.
Pursuant to Chapter 268, the Southold Town Zoning Board of Appeals shall consider this
recommendation in preparing its written determination regarding the consistency of the proposed
action.

Based on the information you have submitted, the New York State Department of Environmental
Conservation has determined that the property landward of the topographic crest of the bluff, as
shown on the survey prepared by John Minto on 9/26/08, is beyond Article 25 jurisdiction.
Therefore, in accordance with the current Tidal Wetlands Land Use Regulations (6NYCRR Part
661) no permit is required under.the Tidal Wetlands Act. Please be advised, however, that no
construction, sedimentation, or disturbance of any kind may take place seaward of the tidal wetlands
jurisdictional boundary, as indicated above, without a permit. It is your responsibility to ens.ure that
all ndcessary precautions are taken to prevent any sedimentation or other alteration or disturbance to
the ground surface or vegetation within Tidal Wetlands jurisdiction which may result from your
project. Such precautions may include maintairdng adequate work area between the tidal wetland
jurisdictional boundary and your project (i.e. a 15' to 20' wide construction area) or erecting a
temporary fence, barrier, or hay bale berm.
Please be further advised that this letter does not relieve you of the responsibility of obtaining
any necessary permits or approvals from other agencies.

Dear Chairman Gonbfinger:
As requested, a site review was conducted at 4545 Hallock Lane in Mattituck on March 18, 2009.
The site was evaluated for pot~ntiai natttral resource concerns ~garding the demolition of an ex/sting home
and deck and thc subsequent construction of a new dwelling, porch, terrace, detached garage, and a pool.
The property is located on an eroding bluff on Long Island Sound. The rear ysrd is in dense grass
cover. There is a gentle slope from the house towards .the bluff edge and also towards thc neighboring
property to the west. There was no access to thc bottom of the blu~ However, it was observed from the top
of the bluff that storm tides reach the toe of thc bluff and there is some ~tivc erosion on the bluff face.
Extreme care must be taken during demolition and construction to protect ~he bluff. Construction
equipment must keep as far away from the bluff as possible. Debris of any type must n~ver be d/Sposed of
on the bluff face. Runoff should not be allowed to flow over the bluff edge and down thc bluff face. It is
advised to install temporary structures such as straw bales and s/It £ances to reduce runoff velocity and trap
sediment.. These practices should be installed north and west of the construction area. Sec the attached New
York Standards and Specifications/'or Sediment and Erosion Control for thc proper insl~llation of these
practices. Additionally, see the attached document "Stabilization of Eroding Bluffs" for further
recoiziniandations on restoring thc bluff,
Lastly, the new residence should be fitted w/th gutters ~0d downspouts that outlet into d~ wells.
This will decrease the volume ofnmoffon the pwperty. Provisions must also be made for draini~ the pool;
thc drain water must never be allowed to flow towards the bluff. The site must be re-seeded ~t/ter and
posdbly du~ng construction to maintain grass cover on the lawn. Annual rye grass is recommended for
quick temporary cover during construction while a rye and rescue blend is rec ,oF~manded after construction.

Numerous attempts have been made by la,dowries to stabilize bluff slopes; only a few have
succeeded. Althou~ no procedur~ can guarantee a p~ent solution or stop this eros/on,
the £olldwing measures 'have been found to be the most effective in obtaining the best
possible stabilization of the bluff fac~.
Stabilization of the We and top o£ the bluff (ideally simult~eously) must.occur.
Implementing pract/ces .(such es revegetation, terracing, geo-t~x61es) without achieving this
stability will not be successful.. Res~ting in a loss of time, r',~,ources, and financial
investment as these areas ~re compromised by erosior~
Oncc both of these areas are stabilized, efforts should be focused on rean~tiafing the bluff
face. Although stabilization of the toe and top is recommended first, the environment should
be evaluated holistically. Thereby, retaliation of the bluff face should occur in eo~junction
with and/or as soon as possible altar the remediation of the top and toe.

Top Stabilization:
- ~ Remove the overhanging lip at thc top of the slope creating a natural angle of
repose. This is generally a l:I slope or45 degree angle.
b. Any trees along the top edge of the bluff should be cut at the base leaving the
roots in place. Tall trees swaying in the wind will loosen the bluff soils.
c. Do not allow surface wa~r (i.e. pool water, runoff; irri~tion water) to flow
over the top of the slope. Installation of a diversion with a catch bas/n drain.
and a vegetated natural buffer both serve this purpose;
d. No ground disturbing activities should occur with/. 10 feet of the edge of the
bluff. This includes installation of landscaping plants, irrigation systems,
decks, and fences.
e. Pools should be install~ with an in ground drain to facilitate drainage (unless
clay lenses exist within thc biuffprofilc).

dry wells in order to reduce runoff/lowing over the b!uff edge.

h. Irrigation scheduling should not exceed the peak consumptive requiremants of
the turf grasses (approximately 1" per week).
Toe Stabili~flon:
a. The use of vegetation is the prcfcrrcd method to maintah a stab/lo toe.
However, vci~mtion alone is not always successful, i good indicator of
whether or not vegetation will stabilize the toe is the location of the mean high
tide (IrE-IT) mark. If MHT reaches the toe of the bluff, it is nnllkely that
vegetation alone will stabilize this site. ff this is the situation, a consultation
with NRCS orthe SC SWCD can provide you with other alternatives.
b. If a hardenilig structure, such as a bulkhead or reck rewiiii~-'nt ~xists, it is
critical that proper msintenance occurs to the~ structures. Such regular
maintenance prolongs' the life. The additional bene~ts are the protection the
toe of the bluff and reductio~ in r~air/r~lacement costs.' The following are
the maintc-nsnce activities that should occur oil the bulkhead.
~, Decaying and.or damaged boards should be replaced.
~, Holes behind the bulkhead should be filled with sand.
~ G-eotexlile must be malnlained betwean the bulkhead or revering'at in order
to retain sand behhld the s~roctur~. The lack of geotextile in combJl~atioll
with wave action will pull sedimant through the structure eventually cause
collapse a~d failure.
~, Vegetation (beach grass, Spartina patens, Coastal Panic grass) should be
maintained on top of the bulkhead.
]Bluff Face:
~- Any tr~s along the top e/ige and on the bluff face should be cut at the base
leaving the roots in place.
b. Trash, grass clippings, leaves and branches should not be disposed of on the
bluff face. This creates instability as the debris adds vdeight to the bluff face
and d:~_-.!ly smothers veg~afiorc Thus, such debris should tm removed from
the bluff face and disposed of properly.
c. A natural angle of repose should occur on the bluff face. Depending on the
height and location of the vertical faces, such an angle may not be practical.
Grading is a satisfactory practice to create such a natural slope at locations
where such an angle can be achieved. Care should- be taken to not di,sturb
stabile areas of' the bluff in an attempt to stabilize the eroding locati°ns. Such
precautions will prevent additional erosion problems on the bluff.
d. Re/Vegetate the slope.
~ 'Cape~ American beach grass and Spartina patens plugs should be used
for this pu~osc and transplanted while dormant in the late winter or

Both Spartina and Bcachgrass should bc planted 12" apart. Rows should
be scpami~ by 12" and the plants should be si~gered with plants in
adjacent rows.'
Each full row should consist of entirely Bcachgrass or Spar~na and the
rows should alternate between these the two species. For Beachgrass,
one 3~mm film canister of Osroocote slow wlcase fertilizer should be
placed into cach planting hole and than plant three steo~s or eulmz per
hole.
To add diversity to the bluff planting, redn¢~ the ~roat of disease, and
compensate for natural beach grass die out, it is recommended to
broadcast the following warm season grass mixture immediately prior to

Dear Mr. Frawley:
Based on the information you have submitted, the New York State Department of Environmental
Conservation has determined that the property landward of the topographic crest of the bluff, as
shown on the survey prepared by John Minto on 9/26/08, is beyond Article 25 jurisdiction.
Therefore, in accordance with the current Tidal Wetlands Land Use Regulations (6NYCRR Part
661) no permit is required under the Tidal Wetlands Act. Please be advised, however, that no
construction, sedimentation, or disturbance of any kind may take place seaward of the tidal wetlands
jurisdictional boundary, as indicated above, without a permit. It is your responsibility to ensure that
all n4cessary precautions are taken to prevent any sedimentation or other alteration or disturbance to
the ground surface or vegetation within Tidal Wetlands jurisdiction which may result from your
project. Such precautions may include maintaining adequate work area between the tidal wetland
jurisdictional boundary and your project (i.e. a 15' to 20' wide construction area) or erecting a
temporary fence, barrier, or hay bale berm.
Please be further advised that this letter does not relieve you of the responsibility of obtaining
any necessary permits or approvals from other agencies.
