The proposed float orientation would create no more encroachment on the waterway than would tying the 11'wide boat to the outside of the existing,permitted,shore-parallel float, even without tie-off piles on the seaward side of it,as the shore-perpendicular float would extend approximately 11 feet farther seaward than the existing float. The proposed float orientation would also remain well within the code-required limitation of one-third of the width of the waterway, with a 44'or approximately one-fifth seaward extension from mean lower low water. The proposed dock reconfiguration would also permanently limit the dockage facility's potential seaward intrusion by eliminating the variability of larger boats being docked on the seaward side of the shore-parallel float and instead confming boats to the proposed dockage footprint alongside the shore-perpendicular float. Therefore, the proposed dock reconfiguration would have no adverse impact on the tidal wetlands or waters of the Town. 617.20 Appendix B Short Environmental Assessment Form Instructions for Completing Part I-Project Information. The applicant or project sponsor is responsible for the completion of Part 1.Responses become part of the application for approval or funding, are subject to public review, and may be subject to further verification. The proposed float orientation would also remain well within the code-required limitation of one-third of the width of the waterway, with a 44'or approximately one-fifth seaward extension from mean lower low water. The proposed dock reconfiguration would also permanently limit the dockage facility's potential seaward intrusion by eliminating the variability of larger boats being docked on the seaward side of the shore-parallel float and instead confining boats to the proposed dockage footprint alongside the shore-perpendicular float. Therefore, consistent with Policy 9,the proposal will have no adverse impact on public access to or recreational use of Town Creek. Located: 302 Town Creek Lane, Southold. SCTM#64-1-12 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to us, it is our recommendation the proposed action is CONSISTENT with LWRP policy standards and therefore is CONSISTENT with the LWRP; provided that the action will not interfere with or preclude other important water dependent uses conducted in this water body, will not significantly impair wetland productivity and values and meets all dock standards pursuant to 4 275-11 Construction and operation; specifically dock standards 1 2 and 3 as outlined below. Maritime activity in Southold traditionally has been concentrated in the harbors, inlets and creeks Developed Coast Policy #1 promotes a continuation of the traditional pattern of maritime activity, supportine the economic base, maintainine the maritime character of the Town, and avoiding disturbance of the remaining natural shoreline and water areas. DEVELOPED COAST POLICY Policy 1 Foster a pattern of development in the Town of Southold that enhances community character, preserves open space, makes efficient use of infrastructure, makes beneficial use of a coastal location, and minimizes adverse effects of development. Therp imary components of the desired development pattern are: strengthening the hamlets as centers of activity, maintaining a clear sense of separation between hamlet centers and the countryside encouraging water-dependent uses to concentrate in existing locatisf maritime activity, enhancing stable re tial areas and preserving agriculture open space and environmentally sensitive coastal resources WORKING COAST POLICY Policy 10 Protect Southold's water-dependent uses and promote siting of new waterdependent uses in suitable locations. Maritime activity in Southold traditionally has been concentrated in the harbors inlets and creeks As noted earlier, Policy 1 promotes a continuation of this traditional pattern of maritime activity, supporting the economic base maintaining the maritime character of the Town, and avoiding disturbance of the remaining natural shoreline and water areas. The intent of this Policy is to Protect existine water-dependent commercial industrial and recreational uses and to enhance the economic viability of water-dependent uses by ensurine adequate Provision of infrastructure for water-dependent uses and their efficient operation. This is relevant to Southold because other important concentrations of water-dependent uses are located at Orient Point. If the action is approved, the following best management practices(BMP's) are recommended: 1) Minimize the length of the docking structure to the greatest extent practicable. 2) Design standards allowing for the public to access trust lands and water.
