DECLARATION OF COVENANTS
THIS DECLARATION made this `v day of , 2009, by Silvana
Cadeddu, residing at 100 Harbor View Drive, Unit 530, Port Washington, NY
11050, hereinafter referred to as "DECLARANT" :
W I T N E S S E T H
WHEREAS, DECLARANT is the owner of certain real property located on
Wiggins Lane, Greenport, Town of Southold, County of Suffolk, State of New
York, described in the Suffolk County Tax Map as District 1000, Section 35,
Block 05, Lot 23, which is more particularly bounded and described as set
forth in Schedule "A" annexed hereto, hereinafter referred to as the
Property;
WHEREAS, the Property is situated on lands within the jurisdiction of
the Board of Trustees of the Town of Southold (hereinafter the "Trustees")
pursuant to Chapter 275 of the Town Code of the Town of Southold or its
successor, and various activities conducted upon the property may thus be
subject to the regulation and approval of the Trustees prior to being
conducted;
WHEREAS, the DECLARANT therefore made application to the Trustees for a
permit pursuant to the Wetlands Law of the Town of Southold to undertake
certain regulated activities; and
WHEREAS, as a condition of the granting of a Wetlands Permit to
undertake such regulated activities, the Trustees required that a "nonturf
buffer" be established seaward of the seven-foot elevation contour (1929
NGVD) ,
NOW, THEREFORE, the DECLARANT does hereby covenant and agree as
follows:
I) Upon the substantial completion of the aforementioned permitted
activities there shall be established and subsequently maintained
seaward of the seven-foot elevation contour (1929 NGVD) on the
subject premises a "nonturf buffer" as defined by Chapter 275 of
the Town Code; and
2) This requirement may only be modified by the DECLARANT, her heirs,
assigns, purchasers, or successors in interest upon resolution of
the Trustees.

AUTHORIZATION
Pursuant to the provisions of Chapter 275 and/or Chapter 111 of the Town Code of the Town of
Southold and in accordance with the Resolution of the Board of Trustees adopted at the meeting held on
April 22, 2009, and in consideration of application fee i~x the sum of $250.00 paid by Silvana Cadeddu and
subject to the Terms and Conditions as stated in the Resolution, the Southold Town Board of Trustees
authorizes and permits the following:
Wetland Permit to construct approximately 70 linear feet of vinyl bulkhead in
place of existing timber bulkhead; temporarily remove existing ramp and float and
reconstruct (in-kind/in-place) existing 4'x4.5' cantilevered deck; incidentally dredge to
a maximum depth .of-5 ALW an area up to 8' offthe bulkhead; and remove existing
patio over abandoned boat ramp to be filled with approximately 18 cubic yards
resultant sand/silt spoil and approximately 7 cubic yards clean sand to be trucked in
from an upland source, with the conditions of the deployment of a silt boom
surrounding the immediate project area prior to and during all intertidal operations,
the installation of a non-turf buffer area up to the 7' contour line landward of the
bulkhead, and as depicted on the site plan prepared by En-Consultants, Inc~, last dated
March 12, 2009, and received on March 26, 2009.
IN WITNESS WHEREOF, the said Board of Trustees hereby causes its Corporate Seal to be affixed,
andthese presents to be subscribed by a majority of the said Board as of this date.

TERMS AND CONDITIONS
The Permittee Silvana Cadeddu, residing at 1380 Wiggins Lane, Greenport, New York as part
of the consideration for the issuance of the Permit does understand and prescribe to the
following:
That the said Board of Trustees and the Town of Southold are released from any and all
damages, or claims for damages, of suits arising directly or indirectly as a result of any
operation performed pursuant to this permit, and the said Permittee will, at his or her own
expense, defend any and all such suits initiated by third parties, and the said Permittee
assumes full liability with respect thereto, to the complete exclusion of the Board of
Trustees of the Town of Southold.
That this Permit is valid for a period of 24 months, which is considered to be the estimated
time required to complete the work involved, but should circumstances warrant, request for
an extension may be made to the Board at a later date.
That this Permit should be retained indefinitely, or as long as the said Permittee wishes to
maintain the structure or project involved, to provide evidence to anyone concerned that
authorization was originally obtained.
That the work involved will be subject to the inspection and approval of the Board or its
agents, and non-compliance with the provisions of the originating application may be cause
for revocation of this Permit by resolution of the said Board.
That there will be no unreasonable interference with navigation as a result of the work
herein authorized.
That there shall be no interference with the right of the public to pass and repass along the
beach between high and low water marks.
That if future operations of the Town of Southold require the removal and/or alterations in
the location of the work herein authorized, or if, in the opinion of the Board of Trustees,
the work shall cause unreasonable obstruction to free navigation, the said Permittee will be
required, upon due notice, to remove or alter this work project herein stated without
expenses to the Town of Southold.
The Permittee is required to provide evidence that a copy of this Trustee permit has been
recorded with the Suffolk County Department of Real Properties Office as a notice
covenant and deed restriction to the deed of the subject parcel. Such evidence shall be
provided within ninety (90) calendar days of issuance of this permit.
That the said Board will be notified by the Permittee of the completion of the work
authorized.
That the Permittee will obtain all other permits and consents that may be required
supplemental to this permit, which may be subject to revoke upon failure to obtain same.

Dear Mr. Herrmann:
The Board of Town Trustees took the following action during its regular meeting held on
Wednesday, Apdl 22, 2009 regarding the above matter:
WHEREAS, En-Consultants, Inc. on behalf of SILVANA CADEDDU applied to the
Southold Town Trustees for a permit under the provisions of Chapter 275 of the
Southold Town Code, the Wetland Ordinance of the Town of Southold, application
dated March 26, 2009, and,
WHEREAS, said application was referred to the Southold Town Conservation Advisory
Council and to the Local Waterfront Revitalization Program Coordinator for their findings
and recommendations, and,
WHEREAS, in accordance with Chapter 268, said application was found to be Exempt
from the Local Waterfront Revitalization Program policy standards, and,
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said
application on April 22, 2009, at which time all interested persons were given an
opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar with the
premises in question and the Surrounding area', and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the structure complies with the standards set forth in Chapter 275 of the
Southold Town Code,
WHEREAS, the Board has determined that the project as proposed will not affect the
health, safety and general welfare of the people of the town,
NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees approve the application of SILVANA
CADEDDU to construct approximately 70 linear feet of vinyl bulkhead in place of
existing timber bulkhead; temporarily remove existing ramp and float and reconstruct
(in-kind/in-place) existing 4'x4.5' cantilevered deck; incidentally dredge to a maximum
depth of-5 ALW an area up to 8' off the bulkhead; and remove existing patio over
abandoned boat ramp to be filled with approximately 18 cubic yards resultant sand/silt

At the meeting of the Southold Town Conservation Advisory Council held Wed., April 15,
2009, the following recommendation was made:
Moved by Don Wilder, seconded by Peter Young, it was

temporarily remove existing ramp and float and reconstruct (in-kind/in-place) existing 4'X

off the bulkhead; and remove existing patio over abandoned boat ramp to be filled with

The CAC Supports the application with the Condition the pipes on the property that are

1. Indicate the estimated volume of material to be dredged and the depth (below

2. You can apply for a ten-year permit for maintenance dredging. If you wish to
apply for a ten-year permit, please provide the number of additional dredging events
during the ten-year life of the permit and the amount of material to be removed
during future events.

facility maybe subject to wave action from wakes of passing vessels, whose
operations would not be required to be modified. Issuance ora permit would
relieve you of ensuring the ~ntegrit~ of the authorized structure(s) and the United
States would not be held responsible for damages to the structure(s) and vessel(s)
moored thereto from wakes from passing vesseTs.
BULKHEADING/BANK STABILIZATION FILLING ACTIVITIES
Answer the following if your project includes construction of bulkheading (also
retaining walls and seawalls) with backfill, filling of waters~wetlands, or an3' other
bank stabilization fills such as rip-rap, revetments, gabions, etc.
1. Indicate the total volume of fill (including backfill behind a structure such as a
bulkhead) as well as the volume of fill to be placed into waters of the United States.
The amount of fill in waters of the United States, can be determined by calculating
the amount of fill to be placed below the plane of spring high tide in tidal areas and
below ordinary high water in non-tidal areas.

lh) Because the proposal entails dredging activities in coastal waters, the project must be
consistent with Policies 15 and 35. With regard to Policy 15, maintaining navigable water
depths at the subject site should not cause an increase in the erosion of downdrift lands.
With regard to Policy 35, the turbidity likely to result from the dredging activities will be
localized and ephemeral in nature. Therefore, there will be no adverse effects on adjacent
fish habitat. Finally, it will be necessary to secure Article 15 and 25 permits from the
NYSDEC to ensure that the project will meet State dredging permit requirements. Thus,
the proposed project will be consistent with Policies 15 and 35.
2a) The proposed project is located adjacent to State designated tidal wetlands, and thus
must be consistent with Policy 44. Because the project will not affect the benefits derived
from tidal wetlands and will require a Tidal Wetlands Act permit from the NYSDEC, it
will be consistent with Policy 44.
3a) Because the proposed activity will occur at a waterfront site, it must be consistent with
Policies 2, 21, and 22. The project will be consistent with 1) Policy 2 because the proposal
is considered a water dependent use by this policy; and 2) Policy 22 in that it will not
inhibit or preclude existing or future water-related recreation on the adjacent waters.
Policy 22 does not apply to the project.
3c) Because the proposed activity includes construction of an erosion control structure, the
proposed project must be consistent with Policies 13, 14, and 16. Pursuant to Policy 14,
placement of the structure will not cause or increase erosion at adjacent properties. The net
effect of the project should only be to prevent further erosion of the subject property,
without causing adverse effects to adjacent properties.
The structure wilt be designed and constructed in accordance with generally accepted
engineering practice, and thus, excluding any catastrophic occurrences, has a reasonable
probability of controlling erosion for at least thirty years. Therefore, the project is
consistent with Policy 13. Policy 16 is inapplicable to the current project.

vinyl bulkhead in place of existing timber bulkhead; temporarily remove existing ramp and float and reconstruct (in-
kind/in-place) existing 4'X 4.5' cantilevered deck; incidentally dredge to a maximum depth of-5 ALW an area up to 8'
off the bulkhead; and remove existing patio over abandoned boat ramp to be filled with approx. 18 cy. resultant sand/silt

THE FOLLOWING SECTION ADDRESSES THE PROPOSED (IN-KIND/IN-PLACE REPLACEMENT) OF
BULKHEAD, DOCK and CANTILEVERED DECK:
The proposed actions have been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold
Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information
provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to us,
it is our recommendation that the proposed actions are EXEMPT pursuant to § 268-3; provided a silt boom (silt
curtain) is deployed surrounding the immediate project area prior to and during all intertidal operations
pursuant to § 268-3 GG.
MINOR ACTIONS -- Include the following actions, which are not subject to review under this chapter:
A. Maintenance or repair involving no substantial changes in an existing structure or faciliiy.
Replacement, rehabilitation or reconstruction of a structure or facility, in kind, on the same site, including
upgrading buildings to meet building or fire codes, except for structures in areas designated by the Coastal
Erosion Hazard Area (CEHA) law where structures may not be replaced rehabilitated or reconstructed without
a permit.
GG. Bulkhead to replace existing bulkhead on the applicant's property in the same location with a silt curtain
employed during construction.
THE FOLLOWING SECTION ADDRESSES THE PROPOSED DREDGING:
The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town
Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided
on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to us, it is our
recommendation that the proposed action is CONSISTENT with LWRP policy standards and therefore is
CONSISTENT with the LWRP.
The Following Best Management Practice (BMP) is required pursuant to § 275-11 A (2) and § 268-3 GG:

The deploy~nent of silt boom surrounding the immediate project area prior to and during all intertidal
operations,
The deployment of a silt boom will further protect and enhance the quality of the Town's coastal waters and
protect water quality of coastal waters from adverse,impacts associated with dredging and disposal of dredge
material. Furthermore~ the deployment of silt booms as a Best Management Practice will further advance LWRP
Policy 5~ Protect and improve water quality in the Town of Southold and LWRP Policy 6 Protect and restore tidal
and fresh water wetlands.
The Following Best Management Practice (BMP) is recommended:
2) Establish a minimum 20' non~turf vegetative buffer landward of the bulkhead.

Attached please find an LWRP Consistency Assessment Form, which is being submitted in
association with an application to the Board of Trustees for a Town Wetlands Permit to replace
(in-place) existing bulkheading on the captioned property.
I have indicated that all policies are "Not Applicable" because pursuant to Town Code §268-5
("Review of Actions") and the corresponding definitions of "action" and "minor action" by
§286-3 ("Definitions"), the proposed project meets the following definitions of minor actions
