The Permittee is required to provide evidence that a copy of this Trustee permit has been recorded with the Suffolk County Department of Real Properties Office as a notice covenant and deed restriction to the deed of the subject parcel. With regard to Policy 35, the turbidity likely to result from the dredging activities will be localized and ephemeral in nature. Therefore, there will be no adverse effects on adjacent fish habitat. Finally, it will be necessary to secure Article 15 and 25 permits from the NYSDEC to ensure that the project will meet State dredging permit requirements. Thus, the proposed project will be consistent with Policies 15 and 35. 2a) The proposed project is located adjacent to State designated tidal wetlands, and thus must be consistent with Policy 44. Because the project will not affect the benefits derived from tidal wetlands and will require a Tidal Wetlands Act permit from the NYSDEC, it will be consistent with Policy 44. 3a) Because the proposed activity will occur at a waterfront site, it must be consistent with Policies 2, 21, and 22. The project will be consistent with 1) Policy 2 because the proposal is considered a water dependent use by this policy; and 2) Policy 22 in that it will not inhibit or preclude existing or future water-related recreation on the adjacent waters. Policy 22 does not apply to the project. 3c) Because the proposed activity includes construction of an erosion control structure, the proposed project must be consistent with Policies 13, 14, and 16. Pursuant to Policy 14, placement of the structure will not cause or increase erosion at adjacent properties.
