LOCAL WATERFRONT REVITALIZATION PROGRAM COORDINATOR
TOWN OF SOUTHOLD
MEMORANDUM
To: James King, President
Town of Southold Board of Trustees
From: Mark Terry, Principal Plam~er
LWRP Coordinator
Date: March 17, 2008
Request for Wetland Permit for Cleaves Property Owners Association
SCTM# 35-6-30
CLEAVES POINT POA requests a Wetland Permit to resheath sections, totaling up to 32+/-
linear fl. maximum, of the landward side of existing bulkhead using vinyl, T&G plank sheathing
with filter fabric liner, and backfill with 20+/- cy. of clean sand from an upland source. Located:
345 Osprey Nest Rd., Greenport. SCTM#35-6-30
The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the
Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy
Standards. Based upon the information provided on the LWRP Consistency Assessment Form
submitted to this department, as well as the records available to me, it is my recommendation
that the proposed action is CONSISTENT with the Policy Standards and therefore is
CONSISTENT with the LWRP. It is recommended that the following be applied to further the
below listed policies.
Policy 5. Protect attd improve water quality' attd supply bt the Town of Southold.
1. Minimize the use of chromated copper arsenate (CCA) treated wood in the construction of the
structure pursuant to § 275-11. B,1 (f) Construction and operation standards below.
In order to prevent the release of metals and other contaminants into the wet[ands
and waters of Southold, the use of lumber treated with chromated copper arsenate (also
k~town as "CCA "), creosote, penta products or homemade wood preservatives is
prohibited./hr use in sheathing and decking. Preservatives of any type, including but not
limited to those listed above cannot be applied to any bulkheads, retaining walls or
revetments after installation. Encapsulated pilings or native nonchemically treated
(untreated) lumber only should be used in sensitive areas.
2. Require the installation of a silt boom (where feasible) pursuant to § 275-11. (2) Construction
and operation standards below.
2) Erosion control. Installation of an erosion control structure is necessary during
any building, grading, landscaping or site work activity within Trustee jurisdiction. This
structure may include, but is not limited to, installation ora silt fence, hay bales, wood
chip berm and silt booms. The placement of the erosion control structure(s) shall be
determined by the Trustees or their designee. All intertidal construction and excavation
requires the installation of a silt boom that will retain all suspended sediments within the
immediate project area.
In addition to further Policies 5, Protect and improve water quality in the Town of Southold and
6.3 Protect and restore tidal and freshwater wetlands, item D (below). It is recommended that a
non-turf buffer be required landward o f the bulkhead.
Provide adequate buffers between wetlands and adjacent or nearby uses and activities in
order to ensure protection of the wetland's character, quality, values, and functions.
Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing
its written determination regarding the consistency of the proposed action.

' LWRP CONSISTENCY ASSESSMENT FORM
Policy 1 Foster a pattern of development in the Town of Southold that enhances com-
munity character, preserves open space, makes efficient use of infrastructure,
makes beneficial use of a coastal location, and nHnimizeS adverse effects of ·
development.
[-]YES ~NO [--] NOT APPLICABLE F~ 2 ','$
The repair and strengthening of an existing bulkhead is not inconsistent with the
character of the waterfront community, and because of the relatively small foot-
print of the existing bulkhead it is felt that there is 'no adverse impact on the desired
preservation of open space. Infrastructure use is not a factor since the project is ac-
cessory to and accessed from private property. The maintenance of the erosion
control purpose of the bulkhead is certainly a beneficial use of the coastal location,
and there is no incremental increase in development in the area since the bulkhead
already exists in the same form as it will have after completion of the project.
Policy 2 Preserve historic resources of the Town of Southold.
[] YEs [] NOTAPPLmABLE
There is no evidence to indicate that the immediate area of the project includes his-
toric features, and it is to be expected that the proximity &the project area to inter-
tidal lands would suggest that the area is unlikely to have been the site of recover-
able artifacts of past civilizations.
Policy 3
[] YEs
Enhance visual quality and protect scenic resources throughout the Town of
Southold.
~NO [] NOT APPLICABLE
The bulkhead repair and strengthening will be done in such a manner that upon
completion of the project there will be no apparent change in the project site, since
the added construction members will be mainly underground. The existing bulk-
head, which will retain its current form, is compatible with other existing shoreline
structures in the area, and will not adversely affect dynamic landscape elements
(tidal fluctuations, seasonal vegetation changes; seasonal/diurnal changes in ambi-
ent light) wkich might contribute to ephemeral visual qualities.
Policy 4 Minimize loss of life, structures, and natural resources from flooding and ero-
sion.
[] YES ~O [] NOT APPLICABLE
It is intuitively obvious that the likelihood of the proposed activity contributing to
increased hazards which could result in the loss of life from flooding or erosion is
probably minimal to non-existent. The proposed bulkhead repair and strengthen-
ing will have a significant positive effect on the protection of structures and natural
resources from flooding and erosion in that the existing bulkhead, which currently
provides those features, is tending toward failure and its repair is required in order
that these protective features continue in effect.
Policy 5 Protect and improve water quality and supply in the Town of Southold.
[] YES ~II~NO [] NOT APPLICABLE
The project will not have any effect, either positive or negative, upon water quality
and supply in the Town of Southold.
Policy 6
Protect and restore the quality and function of the Town of Southold's ecosys-
tem.
[] YES ~0 [] NOT APPLICABLE
The project presumably will extend the useful life of the existing bulkhead and
hence delay the time when the bulkhead will either fail or must be replaced, and
therefore delay the time at which either of those eventualities could generate some
degree of impact upon the Town's ecosystem. In the meantime, the project of itself
will have no direct effect upon the Town's ecosystem, however that may be de-
fined. The project will have no adverse effect upon exist'mg tidal patterns and there
will be no degradation of water quality.
All statutory and regulatory requirements, at all levels of government, will be
strictly complied with. No dredging, excavating, or filling in wetlands is included
in the project.
Policy 7
[] YES
Protect and improve air quality in the Town of Southold.
~NO [] NOT APPLICABLE
Activities to accomplish the project will not result in significant amounts of new
air pollution, nor will the existence of the repaired bulkhead upon completion of
the project..
Policy 8 Minimize environmental degradation in the Town of Southold from solid
waste and hazardous substances and wastes.
[] YES ~NO [] NOT APPLICABLE
The project as proposed will not result in the generation of any additional solid
waste. The handling and storage of petroleum products, if any, will be accom-
plished through the use of approved containers and facilities, and approved meth-
ods of handling and storage will be followed.
Policy 9

lands, and public resources of the Town of Southold.

dependent uses in suitable locations.
