En-Consultants, Inc. on behalf of PATRICK SCOLLARD requests an Amendment to Permit
#5701 to construct approx. 88 linear ft. of 100-200 lb. stone rip-rap atop landward side of
existing rip-rap and backfill with approx. 50 cy. clean sand fill to be trucked in from an upland
source and planted with Cape American Beachgrass (12' on center). Located: 905 Willis Creek
Dr., Mattituck. SCTM# 123-10-3
The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the
Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy
Standards. Based upon the infomiation provided on the LWRP Consistency Assessment Form
submitted to this department, as well as the records available to me, it is my recommendation
that the proposed action is CONSISTENT with the following Policy Standards and
therefore is CONSISTENT with the LWRP. To further the policies of the LWRP the
following is recommended.
If the action is approved the following best management practices (BMP's) are recommended:
1. Require that construction practices minimize destruction of the existing
vegetation.
Require that an,/areas disturbed due to the construction of the rock revetment be
re-planted with native vegetation.
3. Require a significant non-disturbance buffer landward of the proposed rock
revetment.
The BMP will further Policies 5, Protect and improve water quality in the Town of Southold and
6.3, Protect and restore tidal and freshwater wetlands, item D (below).
Provide adequate buffers bem,een wetlands and adjacent or nearby uses and activities
in order to ensure protection of the wetland's character, quality, values, and functions.
Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing
its written determination regarding the consistency of the proposed action.

Before answering the questions in Section C, the preparer of this form should review the exempt
minor action list, policies and explanations of each policy contained in the Town of Southold Local
Waterfront Revitalization Program. A proposed action will be evaluated as to its significant
beneficial and adverse effects upon the coastal area (which includes all of Southold Town).
If any question in Section C on this form is answered "yes" or "no", then the proposed action will
affect the achievement of the LWRP policy standards and conditions contained in the consistency
review law. Thus,~ each answer must be explained in detaiL~ listing both supporting and non-
suooortino facts. If an action cannot be certified as consistent with the LWRP policy standards and
conditions, it shall not be undertaken.

THIS PROPOSAL REPRESENTS A MINOR MODIFICATION TO A PREVIOUSLY PERMITTED PROJECT THAT
INCORPORATED BOTH STRUCTURAL AND VEGETATIVE MEASURES TO STEM NOT ONLY THE LOSS OF UPLAND
BUT ALSO THE CHRONIC LOSS OF INTERTIDAL MARSH. SPECIFICALLY, A LOW-SILL VINYL BULKHEAD AND
MARSH PLANTINGS COMPRISED THE SEAWARD COMPONENT, AND RIP-RAP PLACED AT THE ACTIVELY ERODING
TOE OF BERM COMPRISED THE LANDWARD COMPONENT. WHILE THE PROJECT HAS SUCCESSFULLY
REESTABLISHED THE TIDAL MARSH HABITAT AND MITIGATED THE UPLAND EROSION, THE RIP-RAP HAS BEEN
OVERTOPPED AND THE BEACH GRASS PLANTINGS LOST FROM BEHIND IT. THEREFORE, A VERTICAL EXPANSION
OF THE RIP-RAP WITH HEAVIER STONE IS PROPOSED TO BETTER MAINTAIN THE FILL AND PLANTINGS TO BE
REESTABLISHED BEHIND IT. AS THE ORIGINALLY IMPLEMENTED PROJECT AND IT S IMPACTS HAVE BEEN
CONSISTENT WITH THE POLICY OBJECTIVE OF POLICY 4, THE PROJECT AS MODIFIED WOULD REMAlN SO.

AS ALLUDED TO ABOVE, THIS OVERALL EROSION CONTROL INITIATIVE HAS EFFECTIVELY MAINTAINED,
ENHANCED, AND EXPANDED UPON THE EXISTING MARSH HABlTAT THAT HAD BEEN PREVIOUSLY ERODING DUE
