En-Consultants, Inc. on behalf of ROBERT & HELEN KEITH requests an Amendment to
Permit #5700 to extend the existing stone rip-rap along eroded embankment by adding approx.
161 linear ft. of 50-100 lb. stone on filter cloth on grade along toe of escarped embm~dnent.

The proposed action has been revie;ved to Chapter 268, Waterfront Consistency Review of the
Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy
Standards. Based upon the information provided on the LWRP Consistency Assessment Form
submitted to this department, as ;vell as the records available to me, it is my recommendation
that the proposed action is CONSISTENT with the following Policy Standards and
therefore is CONSISTENT with the LWRP. To further the policies of the LWRP the
following is recommended.
If the action is approved the followin~ best managemcnt practices (BMP's) are recommended:
Require that construction practices nfinimize destruction of the existing
vegetation.
Require that an,/areas disturbed due to the construction of the rock revetment be
re-planted with native veaetation.
Require a significant non-disturbance buffer landward of the proposed rock
revetment.
The BMP will further Policies 5, Protect and improve water quality in the Town of Southold and
6.3, Protect and restore tidal and freshwater wetlands, item D (below).
D. Provide adequate buffers between ,vetlancls and adjacent or nearby uses and activities
in order to ensure protection of the wetland%' character, quality, values, and functions.
Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing
its written determination regarding the consistency of the proposed action.

2. Before answering the questions in Section C, the preparer of this form should review the exempt
minor action list, policies and explanations of each policy contained in the Town of Southold Local
Waterfront Revitalization Program. A proposed action will be evaluated as to its significant
beneficial and adverse effects upon the coastal area (which includes all of Southold Town).
If any question in Section C on this form is answered "yes" or "no", then the proposed action will
affect the achievement of the LWRP policy standards and conditions contained in the consistency
review law. Thus~ each answer must be explained in detail~ listing both supporting and non-
suDDortin~ facts. If an action cannot be certified as consistent with the LWRP policy standards and
conditions, it shall not be undertaken.

THIS PROPOSAL REPRESENTS A MINOR MODIFICATION TO A PREVIOUSLY PERMITTED PROJECT THAT
INCORPORATED BOTH STRUCTURAL AND VEGETATIVE MEASURES TO STEM NOT ONLY THE LOSS OF UPLAND
BUT ALSO THE CHRONIC LOSS OF INTERTIDAL MARSH. SPECIFICALLY, A LOW-SILL VINYL BULKHEAD AND
MARSH PLANTING COMPRISED THE SEAWARD COMPONENT, AND RIP-RAP PLACED AT THE ACTIVELY ERODING
TOE OF BERM COMPRISED THE LANDWARD COMPONENT. WHILE THE PROJECT HAS SUCCESSFULLY
REESTABLISHED THE TIDAL MARSH HABITAT AND CONTROLLED THE UPLAND EROS1ON WHERE THE RIP-RAP
WAS PLACED, THE REMAINING, UNPROTECTED BERM HAS CONTINUED TO ERODE. THEREFORE, AN EXTENSION
OF RIP-RAP IS PROPOSED TO CONTROL EROSION IN THOSE AREAS AS WELL. AS THE ORIGINALLY IMPLEMENTED
PROJECT AND IT S IMPACTS HAVE BEEN CONSISTENT WITH THE POLICY OBJECTIVE OF POLICY 4, THE PROJECT AS
MODIFIED WOULD REMAIN SO.
