Proposed Wetland Permit for Anita and John Vassil
SCTM#1000-90-3-1
JOHN & ANITA VASSIL request a Wetland Permit to construct approx. 168 linear ft. of vinyl
bulkhead in place of existing timber bulkhead; construct +/-20' and +/-14' vinyl bulkhead returns
immediately landward of the existing timber returns to be removed; and backfill with approx. 30
cy. clean sand fill to be trucked in from an upland source. Located: 495 Rochelle Place,
Mattituck. SCTM#90-3-1
The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the
Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy
Standards. Based upon the information provided on the LWRP Consistency Assessment Fmrn
submitted to this department, as well as the records available to me, it is my recommendation
that the proposed action is CONSISTENT with the Policy Standards and therefore is
CONSISTENT with the LWRP. It is recommended that the following be applied to further the
below listed policies.
Policy 5. Protect and improve water qualiO~ and supply in the Town of Southold.
1. Minimize the use of chromated copper arsenate (CCA) treated wood in the construction of the
structure pursuant to § 275-11. B,1 (f) Construction and operation standards below.
(19 In order to prevent the release of metals and other contaminants into the wel[alids
and waters of Southold, the use of lumber treated with chromated copper arsenate (also
known as "CCA "), creosote, penta products or homemade wood preserw~tives is
prohibited for use in sheathing and decki~*g. Preservatives of any O'pe, incltMi~g bt~t not
limited to those listed above cannot be applied to any bulkheads, retaining walls or
revetments after installation. Eneapsulated pilings or native nonehemically treated
(untreated) lumber only should be used itt sensitive areas.
2. Require the installation of a silt boom (where feasible) pursuant to § 275-11. (2) Construction
and operation standards below.
2) Erosion control. Installation of an erosion control structure is necessary during
any building, grading, landscaping or site work activity within Trustee jurisdiction. This
structure may include, but is not limited to, installation of a silt fence, hay bales, wood
chip berm and silt booms. The placement of the erosion control structure(s) shall be
determined by the D~ustees or their designee. All intertidal construction and excavation
requires the installation of a silt boom that will retain all suspended sediments within the
immediate prc~ject area.
In addition to further Policies 5, Protect and improve water quality in the To~vn of Southold and
6.3 Protect and restore tidal and freshwater wetlands, item D (belo~v). It is recommended that a
non-turf buffer be required landward of the bulkhead.
Provide adequate buffers between wetlands and adjacent or nearby uses and activities in
order to ensure protection of the welland's character, quality, values, and functions.
Pursuant to Chapter 268, the Board of Tln_lstees shall consider this recommendation in preparing
its written determination regarding the consistency of the proposed action.

Attached please find an LWRP Consistency Assessmem Form, which is being submitted in
association with an application to the Board of Trustees for a Town Wetlands Permit to construct
a vinyl bulkhead in place of an existing timber bulkhead.
I have indicated that all policies are "Not Applicable," because pursuant to Town Code §268-
5(A) and the corresponding definitions of"action" and "minor action" by §286-3, the submission
of a LWRP Consistency Assessment Form is not required for this application, as the proposed
work entails only the "maintenance or repair involving no substantial changes in an existing
structure or facility," specifically the in-place replacement of an existing bulkhead.

beneficial and adverse effects upon the coastal area (which includes all of Southold Town).
If any question in Section C on this form is answered "yes" or "no", then the proposed action will
affect the achievement of the LWRP policy standards and conditions contained in the consistency
review law. Thus, each answer must be explained in detail~ listing both supporting and non-
