Located: 1280 Sage Blvd., Greenpma. SCTM#53-5-10 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Progranr (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action is INCONSISTENT with the below Policy Standards and therefore is INCONSISTENT with the LWRP. Policy 6. Protect and restore the quality anti fl~nction of the Town of Southold ecosyste~n 6.3 Protect and restore tidal and freshwater wetlands. Comply with statutory and regulatory requirements of the SouthoM Town Board of Trustees laws and regulations Jbr all Andros Patent and other lands under their jurisdiction 1. Comply with Trustee regulations and recommeodations as set forth in Trustee permit conditions. Tile proposal includes two floats, 8'X 20' itl area. The size of thc floats do not comply xxith¢275-11. J/~N - 2. 2008 $CTM #: 1000-53-5-10 CONSISTENCY ASSESSMENT FO Policy 1 [] YES Foster a pattern of development in the Town of Southold that enhances com- munity character, preserves open space, makes efficient use of infrastructure, makes beneficial use of a coastal location, and minimizes adverse effects of development. ~NO [] NOT APPLICABLE The installation of a small private-use dock is consistent with the character of the waterfront community, and because of the relatively small area of the proposed dock it is felt that there is no adverse impact on the desired preservation of open space. Infrastructure use is not a factor since the project is accessory to and ac- cessed from private property. The project is certainly a beneficial use of the coastal location, and the incremental increase in development in the area is insignificant. Policy 2 [] YES Preserve historic resources of the Town of Southold. ~NO [] NOT APPLICABL~, There is no evidence to indicate that the immediate area of the project includes his- toric features, and it is to be expected that because of its tidal nature the project area is unlikely to have been the site of recoverable artifacts of past civilizations. Natural pro- tective features will not be adversely affected Policy 5 [] YES Protect and improve water quality and supply in the Town of Southold. ~NO [] NOT APPLICABLE The proposed project will not include a pump-out station nor will liquid or solid wastes be discharged into the water or wetlands either during installation or during subsequent use. The underwater land in the vicinity of the project will not be sig- nificantly disturbed during installation, nor thereafter during active use of the facil- ity. Policy 6 Protect and restore the quality and function of the Town of Southold's ecosys- tem. [] YES ~NO [] NOT APPLICABLE There is no observable wetlands vegetation in the immediate area of the proposed facility, or which would suffer significant adverse impacts as a result of the instal- lation of the proposed facility, and the project is not located in any of the nineteen State-designated Significant Coastal Fish and Wildlife Habitats located within Southold Town. The project is within 140' ora large and busy commercial marina, which location would more than likely be minimally attractive to both natural flora and fauna, and it is to be expected that this minimal incremental increase in development will not further degrade local ecological components, or results in the functional loss of ecological components. The f~agrnentation of ecological commtmities should not be a factor, since the proposed project is perceived as being within the existing sphere of development in this "comer" of the basin enclosing the Brick Cove Ma- rina. All statutory and regulatory requirements, at all levels of government, will be strictly complied with. No dredging, excavating, or filling is proposed. The handling and storage of petroleum products, if any, will be accom- plished through the use of approved containers and facilities, and approved meth- ods of handling and storage will be followed. Provide for public access to, and recreational use of, coastal waters, public lands, and p~lic resources of the Town of Southold.
