ISABELLE HOULBREQUE requests a Wetland Permit to remove 56' of existing bulkhead
and 52' of existing 3.5' wide ~vooden walkway and replace same in-place using C-Loc vinyl
sheathing for bulkhead. Located: 210 Knoll Circle, East Marion. SCTM#37-5-16
The proposed action has been revie~ved to Chapter 268, Watcrfi'ont Consistency Review of the
Town of Southold Town Code and the Local Waterfront Revitalization Progranr (LWRP) Policy
Standards. Based upon the information provided on the LWRP Consistency Assessment Fom~
submitted to this department, as well as the records available to me, it is my recommendation
that the proposed action is CONSISTENT with the Policy Standards and therefore is
CONSISTENT with the LWRP, with the condition that the following Best Management
Practices be followed to further the below listed policies:
Policy 5. Protect attd improve water quality attd supply itt the Town of Southold.
1. Minimize the use of chromated copper arsenate (CCA) treated wood in the construction of the
structure pursuant to § 275-11. B,1 (f) Construction and operation standards below.
In order to prevent the release of metals and other contaminants into the wetlands
and waters of Southold, the use of lumber treated with chromated copper arsenate (also
known as "CCA'9, creosote, penta products or homemade wood preservatives is
prohibited for use in sheathing and decking. Presem~atives of any OJpe, inch~ding but not
limited to those listed above can~tot be applied to any bu[l&eacls, retaining walls or
revetments after installation. Encapsulated pilings or native nonchemically treated
(untreated) lumber only shouhl be used itt sensitive areas.
2. Require the installation of a silt boom (wbere feasible) pursuant to § 275-11. (2) Construction
and operation standards below.
2) Erosion control. [nstallation of an erosion control structure is necessary during
any building, grading, landscaping or site work activity within Trustee jurisdiction. This
structure may include, but is not limited to, installation ora silt fence, hay bales, wood
chip berm and silt booms. The p[acement of the erosion control structure(s) shall be
determined by the Trustees or their designee. All intertidal construction and excavation
requires the instal[ation ora silt boom that will retain all suspended sediments within the
immediate project area.
In addition to also further Policies 5, Protect and improve water quality in the Town of Southold
and 6.3 Protect and restore tidal and freshwater wetlands, item D (below). It is recommended
that a minimum 15 foot non-turf buffer be required landward of the bulkhead.
Provide adequate buff'ers between wetlands and adjacent or nearby uses and activities in
order to ensure ;~rotection of the wetland's character, quality, values, and functions.
Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing
its written detem~ination regarding the consistency of the proposed action.
A. INSTRUCTIONS
All applicants for permits* including Town of Southold agencies, shall complete this (;CAF
proposed actions that are subject to the Town of Southold Waterfront Consistency Review I.a;~. Ih~s
assessment is intended to supplement other information used by a Town of Southold agcnc~
malting a determination of consistency. *Except minor exempt actions including Building ?eri~4L;
and other ministerial permits not located within the Coaxtal Erosion Hazard Area.
Before answering the questions in Secron C, tl3e preparer of tttis form should review tile
minor action list, policies and explanations of each policy contained in the Town of Southold
Waterfront Revitalization Program. A proposed action will be evaluated as to its signilicamt
beneficial and adverse effects upon the coastal area (which includes ali of Southold Town)

achievement of the LWRP policy standards and conditions contained in the consistency ~;ex iow lax~
Thus, the action should be analyzed in more detail and, if necessary, modified prior' to m;ikm~ ii

standards and conditions. If an action cannot be certified as consistent with the LWRP polici
standards and conditions, it shall not be undertaken.

DEVELOPED COAST POI~CZES
Policy 1 Foster a pattern of development in the Town of Southold that enhances community
character, preserves open space, makes efficient use of infrastructure, makes beneficial
use of a coastal location, and minimizes adverse effects of development.
This is a waterfront piece of prope~o/that is presently bulkheaded. The bulkhead is failing and needs
to be reconstructed. There will be no increased development and our proposal is an effort to
maintain existing structures.
Policy 2
Preserve historic resources of the Town of Southold.
This property has no significant historic resources.
Policy 3
Enhance visual quality and protect scenic roseurces throughout the Town of Southold.
The bulkhead at this location is existing. The present condition of this bulkhead is showing its age by
presenting holes in the sheathing and leaking of backfill. A new bulkhead is just an attempt of the
upland property owner to maintain her property. The visual quality and scenic resources will remain
the same.
NATURAL COAST POL~CZES
Policy 4 Minimize less of life, structures, and natural resources from flooding and erosion.
The existing bulkhead is needed to protect the upland property. This shoreline is mostly reinforced
with erosion control structures. The new bulkhead will not increase flooding or erosion in this area,

Protect and improve water quality and supply in the Town of Southold.
This proposal will not have any impact on the water quality and supply of the Town of Southold,
Policy 6
Protect and restore the quality and function of the Town of Southold's ecosystem.
This proposal will not have any impact on the Town of Southold's ecosystem. The project site is
located in a homeowner's association where most of the waterfront is bulkheaded,

This proposal will not have any impact on the air quality of the Town of Southold.

Our proposal will not limit public access to the coastal waters or public resources of the Town of
Southold. There is a bulkhead presenUy existing and we are proposing for in-place construction.

Policy 10 Protect the Town of Southold's water-dependent uses and promote siting of new water-
dependent uses in suitable locations.
Our proposal is to reconstruct a failing bulkhead. The present condition of the bulkhead is poor and
is unsafe. The construction of a new bulkhead in its place will allow the property owners to safely
approach this waterfront.
Policy 11
Promote sustainable use of living marine resources in the Town of Southoid.
This proposal will have no impact on the marine resources in the Town of Southold. There are no
vegetative wetlands in this area.
Policy 12
Protect: agricultural lands in the Town of Southold.
This proposal has no impact on the agricultural lands in the Town of Southold.
Policy 13 Promote appropriate use and development of energy and mineral resources.
This proposal has no influence on the development of energy and mineral resources.
