Request for Wetland Permit for Pamela J. Williams Revocable Living Trust

PAMELA J. WILLIAMS REVOCABLE LIVING TRUST requests a Wetland Permit to
construct approx. 101 linear ft. of vinyl bulkhead in place of existing timber bulkhead; remove
and replace (in-place) approx. 16 linear ft. of existing timber retaining wall and remove
remaining portions of wall; construct a 10'X 16' deck and 4' wood walkway along bulkhead;
backfill with approx. 25 cy. clean sand to be trucked in from an upland source; and reconstruct
existing deck and stairs (in-place) as necessary. Located: 1110 Cedar Point Drive East, Southold.

The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the
Town of Southold Toxvn Code and the Local Waterfront Revitalization Program (LWRP) Policy
Standards. Based upon the information provided on the LWRP Consistency Assessment Form
submitted to this department, as well as the records available to me, it is my recommendation
that the proposed action is exempt from review pursuant to Chapter 268-3, Exempt Minor
Actions, item B which states:
"Replacement, rehabilitation or reconstruction of a structure or fi~ciliO:, in kind, on the same
site, including upgrading buildinT, s to meet buihling or fire codes, except for structures in areas
designated l? the Coastal Erosion ltazard Area (CEllA) law where structures may not be
reflaced, rehabilitated or reconstructed u ithou! a permit".

Dear Mr. Terry:
Attached please find an LWRP Consistency Assessment Form, which is being submitted in
association with an application to the Board of Trnstces for a Town Wetlands Permit to construct
a vinyl bulkhead in place of an existing timber bulkhead and to remove and replace (in-place) a
portion of an existing timber retaining wall located landward thereof.
I have indicated that all policies are "Not Applicable," because pursuant to Town Code §268-
5(A) and the corresponding definitions of"action" and "minor action" by §286-3, the submission
of a LWRP Consistency Assessment Form is not required for this application, as the proposed
work entails only the "maintenance or repair involving no substantial changes in an existing
structure or facility," specifically the in-place replacement of an existing bulkhead and retaining
wall.

beneficial and adverse effects upon the coastal area (which includes all of Southold Town).
