RICHARD & MARY LOU MANFREDI request a Wetland Pemrit to reconstruct existing
wood deck around the existing pool; remove decking and deck framing as necessary; install ne;v
motorized pool cover; and install new 48" estate fence around pool area, house and garden area.
Located: 170 Hilltop Path, Southold. SCTM#54-1-29
The proposed deck reconstruction has been reviewed to Chapter 268, Waterfront Consistency
Reviexv of the Town of Southold Town Code and the Local Waterfront Revitalization Program
(LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency
Assessment Form submitted to this department, as ;vell as the records available to me, it is my
recommendation that the proposed action is exempt from review pursuant to Chapter 268-3,
Exempt Minor Actions, item B which states:
"Replacement, rehabilitation or reconstruction ora structure or facility, in kind, on the same
site, including upgrading buildings to mee! building or fire codes, except for structures in areas
designated by the Coastal Erosion Hazard Area (CEHA) law where structures may not be
replaced, rehabilitated or reconstructed without a permit ".
The proposed fence is generally CONSISTENT with the Policy Staudards and therefore is
CONSISTENT with the LWRP provided that the following Best Management Practices are
applied to further Policy 6:
1. Require a non distnrbance buffer laudward of the wetland.
Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing
its written determination regarding the consistency of the proposed action.

beneficial and adverse effects upon the coastal area (which includes all of Southold Town).

Thus, tile action should be analyzed in more detail and, if necessary, modified prior to making
determination that it is consistent to the maxhnum extent practicable with the LWRP polic
standards and conditions. If an action cannot be certified as consistent with the LWRP polic
