MARTIN REGINE requests an Amendment to Permit #4367 for the inkind/inplace replacement
of the existing stairs and decks/platforms. Located: 675 Hillcrest Drive North, Orient.

The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the
Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy
Standards. Based upon the information provided on the LWRP Consistency Assessment Form
submitted to this department, as well as the records available to me, it is my recommendation
that the proposed action is exempt from review pursuant to Chapter 268-3, Exempt Minor
Actions, item B which states:
"Replacement, rehabilitation or reconstruction ora structure or facility, in kind, on the same
site, including ul)grading btdlclings to meet buiMi,g or fire codes, except for structures in areas
designated by the Coastal Erosion Hazard Area (CEHA) law where structure6' may not be
replaced, rehabilitated or reconstructed without a permit ".

Attached please fmd an LWRP Consistency Assessment Form, which is being submitted in
association with an application to the Board of Trustees for a Town Wetlands Permit to
reconstruct (in-kind/in-place) an existing and previously ponnltted bluff access stairway.
I have indicated that all policies are "Not Applicable," because pursuant to Town Code §268-
5(A) and the corresponding definitions of"action" and "minor action" by §286-3, the submission
of a LWRP Consistency Assessment Form is not required for this application, as the proposed
work entails only the "maintenance or repair involving no substantial changes in an existing
structure or facility."
