LOHN SCTM# 87-3-57 PATRICK W. LOHN requests a Wetland Permit to demolish and rebuild inkind/inplace, the existing wood frame deck (including footings), and to construct a 12'X 15' wood frame deck extension to the northwest side of said existing deck in order to square off the structure. Located: 2480 Minnehaha Blvd., Southold. SCTM#87-3-57 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action is CONSISTENT with the below Policy Standards and therefore is CONSISTENT with the LWRP; provided that the following Best Management Practices are applied to further the policies: 1. The materials used to build the deck have not been specified. Require that untreated lumber be used in the construction of the deck. 2. Require that the turf beneath the deck is removed to allo~v for drainage. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. This assessment is intended to supplement other information used b~,/T~_v~a~ making a determination of consistency. *Except minor exempt actions including Building Permits and other ministerial permits not located within the Coastal Erosion Hazard Area. Before answering thc questions in Section C, the preparer of this form should review the exempt minor action list, policies and explanations of each policy contained in the Town of Southold Local Waterfront Revitalization Program. A proposed action will be evaluated as to its significant beneficial and adverse effects upon the coastal area (which includes all of Southold Town). If any question in Section C on this form is answered "yes", then the proposed action may affect the achievement of the LWRP policy standards and conditions contained in the consistency review law. Thus, the action should be analyzed in more detail and, if necessary, modified prior to making a determination that it is consistent to the maximum extent practicable with the LWRP policy standards and conditions. If an action cannot be certified as consistent with the LWRP policy standards and conditions, it shall not be undertaken. Foster a pattern of development in the Town of Southold that enhances community character, preserves open space, makes efficient use of infrastructure, makes beneficial use of a coastal location, and minimizes adverse effects of development. See LWRP Section Ill - Policies; Page 2 for evaluation criteria. [] Yes [] No [] Not Applicable The instant proposal is consistent with this policy in that the reconstruction and sli.qht landward expansion of the existing1 deck will maintain the character of the surroundinq neiqhborhood, which currently consists of other similarly improved lots with similar accessary structures li.e. improved waterfront lots with extensive bulkheadinq and deckin.q) as said existingi deckinq has been a part of the nei.qhborhood far many years and in itself has added to the character. In addition, subiect parcel will be in harmony with this "...beneficial use of a coastal location..." in that the subject waterfront lot will be enhanced and improved by the reconstruction and sliqht landward expansion of the existincl deck. The instant praposal will also "...minimize the adverse effects af development" in that the proposed minimal expansion is situated landward of the existing1 deck on a completely bulkheaded property. Accordinqly, I feel that the instant proposal complies with Policy 1. Attach additional sheets if necessary Policy 2. Protect and preserve historic and archaeological resources of the Town of Southold. The surroundinq area is currently comprised of properties improved with similar appurtenances (i.e. improved waterfront lots with extensive bulkheadin.q and deckin.q). Scenic resources, assumedly views of Corey Creek, are not af risk because the existin.q and proposed deck is situated at qrade and can not block any views of said resource. Please note that the existinq deck has existed harmoniously with the surroundinq neiglhborhood for many years. Therefore, I feel that the instant proposal complies with Policy 3. Attach additional sheets if necessary NATURAL COAST POLICIES Policy 4. Minimize loss of life, structures, and natural resources from flooding and erosion. As this is a non-habitable structure, the possibility for any loss of life is neqliqible. Therefore, I feel that the instant proposal fully complies with this Policy.
