EVELYN AND JOSEPH TURCHIANO requests an Amendment to Permit #689 to replace the
access ramp to the floating dock. Located: 450 Deep Hole Dr., Mattituck. SCTM#115-12-5
The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the
To~vn of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy
Standards. Based upon the information provided on the LWRP Consistency Assessment Form
submitted to this department, as well as the records available to me, it is my recommendation
that the proposed action is exempt from review pursuant to Chapter 268-3, Exempt Minor
Actions, item B which states:
"Replacement, rehabilitation or reconstruction ora structure or facility, in kind, on the same
site, including upgrading buildings to meet building or fire codes, except for structures in areas
designated by the Coastal Erosion Hazard Area (CEHA) law where structures may not be
replaced, rehabilitated or reconstructed without a permit".

A. INSTRUCTIONS
LWRP CONSISTENCY ASSESSMENT FORM
All applicants for permits* including Town of Southold agencies, shall complete this CCAF for
proposed actions that are subject to the Town of Southold Waterfront Consistency Review Law. This
assessment is intended to supplement other information used by a Town of Southold agency in
making a determination of consistency. *Except minor exempt actions including Building Permits
and other ministerial permits not located within the Coastal Erosion Hazard Area.
Before answering the questions in Section C, the preparer of this form should review the exempt
minor action list, policies and explanations of each policy contained in the Town of Southold Local
Waterfront Revitalization Program. A proposed action will be evaluated as to its si~iflcant
beneficial and adverse effects upon the coastal area (which includes all of Southold Town).
If any question in Section C on this form is answered "yes" or "no", then the proposed action will
affect the achievement of the LWRP policy standards and conditions contained in the consistency
review law..Thus, each answer must be explained in detail~ listing both supporting and non-
supportin~ facts. If an action cannot be certified as consistent with the LWRP policy standards and
conditions, it shall not be undertaken.

the Town of Southold from any and all damages, claim, for damages or suits that
may arise or occur directly or indirectly es a result of any operation carried on
under and pursuant to this permit~ and will at his own expense, defend any and all
suits which may be brought by third parties, as a result of any operation carried
on pursuant to or in accordance with the terms of this permit~ and assume full
liability with respect thereto to the complete exclusion of said Board of Trustees
and the Town of Southold.
THIS PERMIT is subject to the following terms and conditions:
1. That there shall be no unreasonable interference with navigation as a result of
the work herein authorized.
2. That there shall be no interference with the right of the public to pass and
repass along that portion of the beach between low and high water mark.
3. That the work shall be subject to the supervision and approval of the said
Board of Trustees or its agents.
4. That if future operations of the Town of Southold require the removal and/or
alteration in the location of the work herein authorized, or if, in the opinion
of the Board of Trustees of the Town of Southold, such work shall cause un-
reasonable obstruction to free navigation, the said Joaeph. r....eu~ahiano
will be required upon due notice from the said Board of Trustees, to remove
or alter the location of the work hereby authorized without expense to the
Town of Southold, so as to render navi~atinn reasonably free and unobstruct-
ed.
The auth6rity conferred by this permit may be terminated by the Board of Trustee~

:amply with the terms and conditions herein iml~osed. In the event of such termination,
this permit shall be deemed revoked five (5) days after the date when the Board of
