Box 1179 Southold, NY 11971 Telephone: 631 765-1938 Fax: 631 765-3136 LOCAL WATERFRONT REVITALIZATION PROGRAM COORDINATOR TOWN OF SOUTHOLD MEMORANDUM To: James King, President Town of Southold Board of Trustees From: Mark Terry, LWRP Coordinator Principal Plam~er Date: October 11, 2007 Re~ Request for Wetland Permit for PATRICIA DAWSON SCTM# 1000-86-7-7 PATRICIA DAWSON requests a Wetland Permit for the existing dwelling and deck, steps down slope, concrete retaining wall, 15'X 15' deck extension to west, screened porch, and outdoor sbower. Located: Indian Neck Lane, Peconic. SCTM# 86-7-7 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action is INCONSISTENT with the Policy Standards and therefore is INCONSISTENT with the LWRP: Be advised that the parcel was created in the High House Woods subdivision approved by the Plmming Board in 1980. The following conditions apply: 1. No ne;v residential structures shall be located within 50' of the top edge of the bank along the shoreline. 2. No new sanitary disposal facility shall be constructed or located within 100 feet of the top edge of the bank along Peconic Bay. 3. Clearing and cutting of vegetation within 50 feet of the top edge of the bluff shall be limited to that necessary for maintenance. Policy 6 Protect and restore the quality and function of the Town of Southold ecosystem. 6.3 Protect and restore tidal and freshwater wetlands. Comply with statutory and regulatory requirements of the Southold Town Board of Trustees laws and regulations for all Andros Patent and other lands under their jurisdiction 1. Comply with Trustee regulations and recommendations as set forth in Trustee permit conditions. The proposed setback from the wood deck to the concrete bulkhead is 42.3 feet and the proposed setback from the "new addition" to the top of bluff line is 75.2 feet; a minimum separation distance of 100' is required Chapter § 275-3. Findings; purpose; iurisdiction; setbacks. Please require that the applicant amend the application to meet the above policy to the greatest extent possible. Additionally, if the action is approved and to further Policy 5: Protect and Improve Water Quality in the Town of Southold 1. Require gutters, downspouts and sub-surface dr~ovells to control stormwater runoff. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its ~vritten determination regarding the consistency of the proposed action.
