Located: 3945 Camp Mineola Rd., Mattituck. SCTM#I23-5-30 The in-kind replacement of an existing bulkhead and deck is an exempt Minor Action and not subject to LWRP review pursuant to Chapter 268-3; Items A and B of the Town of Southold To;vn Code. The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the To~vn of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action is exempt from review pursuant to Chapter 268-3, Exempt Minor Actions, item B which states: "Replacement, rehabilitation or reconstruction of a structure or facility, in kind, on the same site, including upgrading buildings to meet building or fire codes, except for structures in areas designated by the Coastal Erosion Hazard Area (CEHA) law where structures may not be replaced, rehabilitated or reconstructed without a permit ". MT/hkc Town of Southold LWRP CONSISTENCY ASSESSMENT FO] INSTRUCTIONS 1. All applicants for permits* including Town of Southold proposed actions that are subject to the Town assessment is intended to supp agency tn making a determination of consistency. *Except minor exempt actions including Building Permits and other ministerial permits not located within the Coastal Erosion Hazard Area. Before answering the questions in Section C, the preparer of this form should review the exempt minor action list, policies and explanations of each policy contained in the Town of Southold Local Waterfront Revitalization Program. A proposed action will be evaluated as to its significant beneficial and adverse effects upon the coastal area (which includes all of Southold Town). If any question in Section C on this form is answered "yes", then the proposed action may affect the achievement of the LWRP policy standards and conditions contained in the consistency review law. Thus, the action should be analyzed in more detail and, if necessary, modified prior to making a determination that it is consistent to the maximum extent practicable with the LWRP policy standards and conditions. If an action cannot be certified as consistent with the LWRP policy standards and conditions, it shall not be undertaken. A copy of the LWRP is available in the following places: online at the Town of Southold's website (southoldtown.northfork.net), the Board of Trustees Office, the Planning Department, all local libraries and the Town Clerk's office. Foster a pattern of development in the Town of Southold that enhances community character, preserves open space, makes efficient use of infrastructure, makes beneficial use of a coastal location, and minimizes adverse effects of development. See LWRP Section III - Policies; Page 2 for evaluation criteria. [] Yes [] No [] Not Applicable Subject proposal is consistent with this policy in that the,siting1 and utilization of the improved erosion - cantrol facilities li.e. reconstructed bull<headina) will maintain the character of the surroundincl neiflhborhood, which currently consists of many similarly improved lots with similar accessory structures (i.e. extensive bulkheadinq alonfl this section of Great Peconic Bay). In addition, subject parcel witl be in harmony with this "...beneficial use of a coastal location..." in that subject waterfront lot will be enhancect and improved by the upqradinfl of the existinq bulkhead in order to control erosion alonf:l the situate shoreline. The instant proposal will also '% .minimize the adverse effects of development" in that construction above the mean hi~lh water mark will drastically reduce the siltation caused by the prelect. Accordinqly, we feel that the instant proposal complies with Policy 1. At~ach additional sheets if necessary Policy 2. Protect and preserve historic and archaeological resources of the Town of Southold. See LWRP Section III - Policies Pages 5 through 7 for evaluation criteria [] Yes [] No [] Not Applicable Subject proposal will not adversely impact the visual quality of the surroundinq area in that the proposal is to reconstruct the existinq timber bulkhead with vinyl sheathinq. This sectian of Great Peconic Bay is almost exclusively bulkheaded. Scenic resources, assumedly views of Great Peconic Bay, are not at risk because the proposed reconstruction will occur on a property which has been bulkheaded for more than 30 years with no adverse impacts to scenic resources. The proposed reconstruction will also "...restore deteriorated...visual components" by replacinq the worn timber bulkheadinq and thereby addinq to the visual quality of the area. Therefore, we feel that the instant praposal complies with Policy 3. Attach additional sheets if necessary NATURAL COAST POLICIES Policy 4. Minimize loss of life, structures, and natural resources from flooding and erosion. See LWRP Section III - Policies Pages 8 through 16 for evaluation criteria [] Yes [] No [] Not Applicable Subject proposal will fully comply with this Policy in that the proposed bulkhead reconstruction is specifically desigtned to minimize and/or prevent loss of life, structures and natural resources from floodinq and erosion. In addition, construction above the mean hiqh water mark will help to "manaqe naviqation infrastructure tn limit adverse impacts on coastal processes" by drastically reducinq the amount of siltation caused by the project and thereby limitingl impacts to Great Peconic Bay. Therefore, we feel that the instant proposal complies with Policy 4. Attach additional sheets if necessary Policy 5. Protect and improve water quality and supply in the Town of Southold. The existinq bulkhead has existed thereon for many years without resultinq in any form of discernible adverse effects to the surroundinq environment. Canstruction occurrinq above the mean hiqh water mark will further "protect and restore ecoloaical auality..." by limitinq the amount of siltatian caused by the instant proposal. Accordinqly, we feel that the instant propasal fully camplies with this policy. Attach additional sheets if necessary Policy 7. Protect and improve air quality in the Town of Southold.
