Install an attendant sanitaW system and to construct a pervious gravel parking area. Located: 74495 Route 25, Greenport. SCTM#45~4-4.1 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of thc Towo of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department as well as the records available to nre, it is my detemrination that the proposed action is generally CONSISTENT with the Policy Standards and therefore is CONSISTENT with the LWRP provided the following best management practices are required to further the policies of the LWRP. POLICY STANDARDS Policy 3. Enhance visual quality and protect scenic resources throughot~t the Towu of Southold. E. Preserve existing vegetation and establish new indigenous vegetatiou to enhauce scenic quality: Preserve existing vegetation which contributes to tbe scenic quality of the landscape. Allow for selective clearing of vegetation to provide public views withoot i~npairing values associated with the affected vegetation. 1. To further this policy it is recommended that all trees greater than 6" in diameter measured 4.5' above the grade be retained on-site. All improvements including parking areas and e~quipment storage areas should be designed to incorporate or avoid trees that meet this criterion. In addition, require that native and drought-tolerant plants be used in landscaping. Policy 4.1. Minimize losses of hnman life and structnres from flooding and erosion hazards. The following management measnres to minimize losses of human life and structures fi'om flooding and erosion hazards are suggested: A. Minimize potential loss and damage by locating development and st~<ctures axvay £rom flooding and erosion hazards A drainage ditch is shown on the eastern portion of the property. Although the portion of the ditch located within the parking area will be filled. A proposal for the remaining drainage ditch bas not been identified. Policy 5. Protect and improve water quality and snpply in the Town of Southold. 5.5 Protect and couserve the qnality and quantity of potable water To fi~rther this policy and protect ground water quality it is recommended that the Planning Board require the following best management practice for the newly coustructed parking areas: 1. Minimize parking surface areas to thc greatest extent practical. Policy 6. Protect and restore the quality and filnctioa of the Town of Southold ecosystem. 6.3 Protect and restore tidal and freshwater wetlauds. A. Comply with statutory and regulatory requirements of the Southold Town Board of Trustees laws and regulations for all Andros Patent and other lands under their jurisdiction. Comply with Trustee regulations and recommendations as set forth in Trustee permit conditions. The proposed setback from the rear parking area to the freshwater wetland system is 54L;a minimum setback of 100 feet is required pursuant to Chapter 275 of the Town of Southold Town Code. Please Lequire that the applicant amend the application to meet the above policy to the greatest extent possible. E. Maintain buffers to ensure that adverse effects of adjacent or nearby development are avoided: 1. Maintain buffers to achieve a high filtration efficiency of surface runofl~ 2. Avoid permanent or u~mecessary disturbance within buffer areas, 3. Maintain existing indigenous vegetation within buffer areas. INSTRUCTIONS All applicants for permits* including Town of Southold agencies, shall complete this CCAF for proposed actions that are subject to the Town of Southold Waterfront Consistency Review Law. This assessment is intended to supplement other information used by a Town of Southold agency in making a determination of consistency. *Except minor exempt actions including Building Permits and other ministerial permits not located within the Coastal Erosion Hazard Area. Before answering the questions in Section C, the preparer of this form should review the exempt minor action list, policies and explanations of each policy contained in the Town of Southold Local Waterfront Revitalization Program. A proposed action will be evaluated as to its significant beneficial and adverse effects upon the coastal area (which includes all of Southold Town). If any question in Section C on this form is answered "yes", then the proposed action may affect the achievement of the LWRP policy standards and conditions contained in the consistency review law. Thus, the action should be analyzed in more detail and, if necessary, modified prior to making a determination that it is consistent to the maximum extent practicable with the LWRP policy standards and conditions. If an action cannot be certified as consistent with the LWRP policy standards and conditions, it shall not be undertaken. Foster a pattern of development in the Town of Southold that enhances community character, preserves open space, makes efficient use of infrastructure, makes beneficial use of a coastal location, and minimizes adverse effects of development. See LWRP Section III - Policies; Page 2 for evaluation criteria. [] Yes [] No [] Not Applicable This proposal maintains the development scheme of the Town of Southold, which is "defined by a pattern of aden aaricultural land intersDersed with development clustered around a number of historic hamlet centers...", by concentratina commercial development in a develooed commercial area. The proposed use is comoatible with zonina and surroundina existina development. The site is not located on the water, and therefore the IDroiect cannot make beneficial use afa coastal location. Aaain, because of the site location, the proposal "minimizes the adverse effects af development" by concentratinq development near existinq development. This facet is also campatible with the Town Master Plan, in that the instant proposal "reflects the interest in preservinq and enhancinq the natural and built environment and providinq opportunities for a level of qrowth and expansion of the economic base that is compatible with the exitinq scale of development, availability of water, existinq sensitive environment of the Town and its historic heritaqe." The subject parcel is not located in or near either of these definingl visual elements. However, the proposed structure has been desiqned to exist harmoniously with the established character of this commercial section of Route 25. The instant proposal will "preserve exisfinq veqefation and establish new indiaenous veqetation to enhance scenic quality" by retaininq existinq deciduous veqetation in the northern portion of the site, and by landscapingl the developed portions with native species. See LWRP Section III - Policies Pages 8 through 16 for evaluation criteria [] Yes [] No [] Not Applicable This Policy is not applicable to the instant proposal as the subject parcel is located at approximately elevation 30' above mean sea level, and the situate qroundwater is located 48' below the existina arade thereby making~ the possibility of damagie from floodingl and/or erosion neglligiible. However, the instant proposal has been desi~lned usinq best manaqement practices, and all proposed structures will be served by dry'wells to handle stormwater runoff thereby further reducingl the chances of dama~te from floodinq and/or erosion. When properly constructed, these items have not resulted in any adverse impacts to drinkinq water. Please be advised that the majority of the surroundinq properties are connected to public water, thereby eliminatinq potential for adverse affects from the proposed sanitary system. In addition, the instant proposal has been desiqned to maximize the separation between the proposed sanitary system and the situate freshwater wetlands located in the northern section of the subject property. Also, the subject parcel is located distant from any coastal waters, thereby eliminatinq the potential for adverse impacts thereto. Therefore, we feel that the proposal is consistent with this policy. Attach additional sheets if necessary Policy 6. Protect and restore the quality and function of the Town of Southold ecosystems including Significant Coastal Fish and Wildlife Habitats and wetlands. Said developed lots have had no adverse impact to the local ecosystems. The proposal will also add wastewater and storm water manaqement devices that are up to current code.
