STEPHEN MATTEINI requests a Wetland Permit to construct a cantilevered platform
5' X 6' extending seaward from top of existing bulkhead; construct stairs to grade with
rise of 9'-10"+/- and run of 14'; install handrails on two sides of platform and seaward
side of stairs. Located: 1060 Willow Terrace Lane, Orient. SCTM#26-2-22
The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review
of the Town of Southold Town Code and the Local Waterfront Revitalization Program
(LWRP) Policy Standards. Based upon the information provided on the LWRP
Consistency Assessment Form submitted to this department, as well as the records
available to me, it is my recommendation that the proposed action is generally
CONSISTENT with the Policy Standards and therefore is CONSISTENT with the
LWRP provided that the following Best Management Practices are applied to
further the policies:
1. No CCA treated lumber is used in the construction of the stairs.
2. The vegetation/Beachgrass landward of the bulkhead is not
disturbed during construction.
Pursuant to Chapter 268 the Board of Trustees shall consider this recommendation in
preparing its written determination regarding the consistency of the proposed action.

Foster a pattern of development in the Town of Southoid that enhances com-
munity character, preserves open space, makes efficient use of infrastructure,
makes beneficial use of a coastal location, and minimizes adverse effects of
development.

The construction of stairs to grade on the seaward side of an existing bulkhead is
consistent with the character of the waterfront community. The bulkhead has ex-
isted in its present location for many years and has served the property owners and
the community well. Because of the project's low profile and unobtrusive appear-
ance it is felt that there is no adverse impact on the desired preservation of open
space, lnfi'astmcture use is not a factor since the project is for the further appropri-
ate development of an existing private location. The project is certainly a benefi-
cial use of the coastal location, and there will not be even an incremental increase
in development in the area.

There is no evidence to indicate that the immediate area of the project includes his-
toric features, and it is to be expected that the mainly intertidal nature of the project
area is unlikely to have been to site of activities of past civilizations.

Southold.

The existing bulkhead is of low profile and will continue to be inconspicuous in its
present location, and the existing natural buffer area landward of the bulkhead con-
tributes to its suitability in this location. The addition of stairs to access the near
shore area at appropriate tides will not be visually intrusive. It is compatible with
other existing shoreline structures in the area, and will not adversely affect the dy-
namic landscape elements (tidal fluctuations, seasonal vegetation changes) which
might contribute to ephemeral visual qualities.

sion.

It is unlikely that the proposed stairs would contribute to increased hazards which
could result in the losses listed. Natural protective features will not be adversely af-
fected.

The proposed addition of stairs to access the near shore area will not have any ef-
fect upon water quality and supply. During construction liquid or solid wastes will
not be discharged into the water or wetlands. Disturbance of the shoreline during
construction will be minimal.

Protect and restore the quality and function of the Town of Southold's ecosys-

The project is located in or immediately adjacent to the Orient Harbor Significant
Coastal Fish and Wildlife Habitat. However, the entire shoreline in the area of the
proposed project (650' northwest and 550' southeast) is hardened either by buik-
heading or by a single rock revetment (-300' northwest), and the entire northeast-
em shore of Orient Harbor is developed. The main thrust of the NYSDOS narrative
appears to be the protection of water quality in the area, and the proposed project
will not have any lasting adverse impact on water quality in Orient Harbor.
All statutory and regulatory requirements, at all levels of government, will be
strictly complied with. No dredging is proposed, and the minimal mount of con-
struction required at grade level seaward of the bulkhead will be conducted in such
a way, with the advice and consent of the Southold Trustees, as to miuimize any
impact upon the waters of Orient Harbor.

cant amounts of new air pollution.

The project as proposed will not result in the generation of any additional solid
waste. The handling and storage of petroleum products during construction will be
accomplished through the use of approved containers and facilities, and methods of
handling and storage in compliance with all applicable local, state and federal
