Dredge 40 cy. from no further than 10' seaward of new wall to restore existing depth of-4 ALW. Install 4'X 6' cantilevered platform and 16' aluminum gangway to access existing 5'X 40' floating dock. Located: 1210 Wiggins Lane, Greenport. SCTM#35-5-22 The in/kind replacement of and/or removal and disposal of existing timber bulkhead is an exempt Minor Action and not subject to LWRP review pursuant to Chapter 268-3; Items A and B of the Town of Southold Town Code, which states: "Replacement, rehabilitation or reconstruction of a structure or facility, in kind, on the same site, including upgrading buildings to meet building or fire codes, except for structures in areas designated by the Coastal Erosion Hazard Area (CEHA) law where structures may not be replaced, rehabilitated or reconstructed without a permit ". In addition, the applicant proposes to dredge in front of bulkhead to below 4-.0' ALW. This action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action is generally CONSISTENT with the Policy Standards and therefore is CONSISTENT with the LWRP provided that: To further support the LWRP and the policies~ assess the feasibili ,ty of the installation of a silt boom/turbidi~, screen to be employed during dred~_ino_ to minimize turbidity in the water column. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action.
