ELAINE ROMAGNOLI requests a Wetland Permit to construct approx. 109 linear ft. of vinyl
bulkhead in place of existing, storm-damaged timber bulkhead; backfill/renourish eroded area
landward of bulkhead with approx. 60 cy. clean sand fill to be trucked in from an upland source
and planted with Cape American Beach Grass (12" on center); and reconstruct inkind/inplace
existing, stom~-damaged masonry patio on grade, as necessary. Located: 1230 First St., New
Suffolk. SCTM#117-7-29
The in-place replacement of existing timber retaining wall, replacement of lost fill, and plantings
is an exempt Minor Action and not subject to LWRP review pursuant to Chapter 268-3; Items A
and B of the Town of Southold Town Code.
The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the
Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy
Standards. Based upon the information provided on the LWRP Consistency Assessment Form
submitted to this department, as well as the records available to me, it is my recommendation
that the proposed action is exempt from review pursuant to Chapter 268-3, Exempt Minor
Actions, item B which states:
"Replacement, rehabilitation or reconstruction of a structure or facility, in kind, on the same
site, including upgrading buildings to meet building or fire codes, except for structures in areas
designated by the CoasIal Erosion Hazard Area (CEHA) law where structures may not be
replaced, rehabilitated or reconstructed without a permit".

Dear Mr. Terry:
Attached please find an LWRP Consistency Assessment Form, which is being submitted in
association with an application to the Board of Trustees for a Town Wetlands Permit to conslmct
a vinyl bulkhead in place of an existing storm-damaged timber bulkhead.
I have indicated that all policies are "Not Applicable," because pursuant to Town Code §268-
5(A) and the corresponding definitions of"action" and "minor action" by §286-3, the submission
of a LWRP Consistency Assessment Form is not required for this application, as the proposed
work entails only the "maintenance or repair involving no substantial changes in an existing
structure or facility," specifically the in-place replacement of an existing bulkhead.

Waterfront Revitalization Program. A proposed action will be evaluated as to its significant
beneficial and adverse effects upon the coastal area (which includes all of Southold Town).
If any question in Section C on this form is answered "yes" or "no", then the proposed action wilt
affect the achievement of the LWRP policy standards and conditions contained in the consistency
review law. Thus~ each answer must be explained in detail,~ listing both supporting and non-
