Request for Wetland Permit for Ralph Panella

RALPH PANELLA requests a Wetland Permit to excavate behind existing bulkhead and
install filter cloth to back side of T&G sheathing to prevent leaks. Backfill excavated area and
fill void areas with approx. 80 cy. clean tracked-in soil. Place filter cloth on top of fill and install
20-50 lb. core stone on top of filter cloth to hold fill in place. Remove 121' of existing bulkhead,
east and west returns. Construct 75' of new bulkhead, 20' east return and 26' west return in-like,
in-place using C-Loc vinyl sheathing. Remove 20' existing jetty and replace in-like, in-place.

The in-kind replacement of existing timber bulkhead and returns, replacement of lost fill, and
replacement in-like, in-place existing jetty is an exempt Minor Action and not subject to LWRP
review pursuant to Chapter 268-3; Items A and B of the Town of Southold Town Code.
The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the
Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy
Standards. Based upon the information provided on the LWRP Consistency Assessment Form
submitted to this department, as well as the records available to me, it is my recommendation
that the proposed action is exempt from review pursuant to Chapter 268-3, Exempt Minor
Actions, item B which states:
"Replacement, rehabilitation or reconstruction of a structure or facility, in kind, on the same
site, including upgrading buildings to meet building or fire codes, except for structures in areas
designated by the Coastal Erosion Hazard Area (CEHA) law where structures may not be
replaced, rehabilitated or reconstructed without a permit",

A. INSTRUCTIONS
All applicants for perm/ts* including Town of South~oid agencies, shall complete this CCAF for
proposed actions that are. subject.to the Town qfSouthold Waterfront Consistency Review Law. This
assessment is intended to supplement other information used by a Town of Southold agency in
making a determination of consistency. *Except minor exempt actions including Building Permits
and other ministerial permits not located within the Coastal Erosion Hazard Area.
Before answering the questions in Section C, the preparer of tlfis form should review the exempt
minor action list, policies and explanations of each policy contained in the Town of Southold Local
Waterfront. Revitalization, Prggram.. A proposed action wilt be evaluated as to its significant
beneficial and adverse ~ffectg upon the coastal area (which includes all of Southold Town).
If any question in Section C on this form is answered "yes", then the proposed action may affect the
achievement of the LWRP 13oligy,standards and cgndifions contained in the consistency review law.
Thus, the action should be analyzed in more detail and, if necessary, modified prior to making a
determination that it is consistent to the maximum extent practicable with the LWRP policy
standards and conditions. If an action cannot be certified as consistent with the LWRP policy
standards and conditions, it shall not be undertaken.

Proposal:
Phase ! - Excavate behind existing bulkhead and install filter cloth to backside of T & G sheathing to
prevent leaks. Back-fill excavated area and fill void areas with clean trucked-in soil. Approximately
80 cubic yards will be required. Place filter cloth on top of fill and install 20-50lbs core stone on top
filter cloth to hold fill in-place.
Phase II -Remove 121' of existing bulkhead, east and west returns. Construct 75' of new bulkhead,
20' of east return and 26' of west return in-like, in-place using "C-LOC" vinyl sheathing. Remove 20'
of existing jetty and replace in-like, in-place.
DEVELOPED COAST POLICIES
Policy I Foster a pattern of development in the Town of Southold that enhances community
character, preserves open space, makes efficient use of infrastructure, makes beneficial
use of a coastal location, and minimizes adverse effects of development.
This is a waterfront piece of property that is presently bulkheaded. The bulkhead is failing and needs
to be reconstructed. There will be no increased development and our proposal is an effort to
maintain existing structures.
Policy 2
Preserve historic resources of the Town of Southold.
This property has no significant historic resources.
Polio/3
Enhance visual quality and protect scenic resources throughout the Town of Southold.
The bulkhead at this location is existing. The present condition of this bulkhead is showing its age by
presenting holes in the sheathing and leaking of backfill. A new bulkhead is just an attempt of the
upland property owner to maintain her property. All structures are existing so the visual quality and
scenic resources will remain the same.
NATURAL COAST POL/CIES
Policy 4 Minimize loss of lifo, structures, and natural resources from flooding and erosion.
The existing bulkhead is needed to protect the upland property. This shoreline is mostly reinforced
with erosion control structures. The new bulkhead will not increase flooding or erosion in this area.
Policy 5
Protect and improve water quality and supply in the Town of Southold.
This proposal will not have any impact on the water quality and supply of the Town of Southold.
Policy 6
Protect and restore the quality and function of the Town of Soutllold's ecosystem.
This proposal will not have any impact on the Town of Southold's ecosystem.

Our proposal will not limit public access to the coastal waters or public resources of the Town of
Southold. There is a bulkhead presently existing and we are proposing for in-place construction.

Policy 10 Protect the Town of Southold's water-dependent uses and promote siting of new water-
dependent uses in suitable locations.
Our proposal is to reconstruct a failing bulkhead. The present condition of the bulkhead is poor and
is unsafe. The construction of a new bulkhead in its place will allow the property owners to safely
approach this waterfront. All structures are in need of reconstruction.
Policy 11
Promote sustainable use of living marine resources in the Town of Southold.
This proposal will have no impact on the marine resources in the Town of Southold. All work is
landward of AHWr4.
Policy 12
Protect agricultural lands in the Town of Southold.
This proposal has no impact on the agricultural lands in the Town of Southold.
Policy 13 Promote appropriate use and development of energy and mineral resources.
