SUE K. ODELL requests a Wetland Permit to construct approx. 21 linear ft. of vinyl bulkhead
~vithin 10" of existing timber bulkhead; reconstruct 3'X 6' steps to beach; reconstruct 3.5' X 3.5'
steps and 4'X 6' platform laudward of bulkhead; and backfill with approx. 5 cy. clean sand to be
trucked in fi'om an upland source. Located: 6500 Indian Neck Lane, Peconic. SCTM#86-7-3.1
The replacement of existing timber bulkhead, steps, and platform and replacement of lost fill is
an exempt Minor Action and not subject to LWRP reviexv pursuaut to Chapter 268-3; Items A
and B of the Town of Southold Town Code.
The proposed action has been reviewed to Chapter 268, Waterfront Consistency Revie~v of the
Town of Southold To~vn Code and the Local Waterfront Revitalization Program (LWRP) Policy
Standards. Based upon the information provided on the LWRP Consistency Assessment Form
submitted to this department, as well as the records available to me, it is my recommendation
that the proposed action is exempt from review pursuant to Chapter 268-3, Exempt Minor
Actions, item B which states:
"Replacement, rehabilitation or reconstruction of a structure or facility, in kind, on the same
site, including upgrading buildings to meet building or fire codes, except for structures in areas
designated by the Coastal Erosion Hazard Area (CEHA) law where structures may not be
replaced, rehabilitated or reconstructed without a permit".

Attached please find an LWRP Consistency Assessment Form, which is being submitted in
association with an application to the Board of Trustees for a Town Wetlands Permit to replace
an existing timber bulkhead with a vinyl bulkhead to be located immediately seaward thereof
(within 10 inebes of existing bulkhead sheathing).
I have indicated that ail policies are "Not Applicable," because pursuant to Town Code §95-5(A)
and the corresponding defmitions of "action" and "minor action" by §95-3, the submission of a

2. Before answering the questions in Section C, the preparer of this form should review the exempt

Waterfront Revitalization Program. A proposed action will be evaluated as to its significant
beneficial and adverse effects upon the coastal area (which includes all of Southold Town).
If any question in Section C on this form is answered "yes" or "no", then the proposed action will
affect the achievement of the LWRP policy standards and conditions contained in the consistency
review law. Thus, each answer must be explained in detail, listing both supporting and non-
supporting facts. If an action cannot be certified as consistent with the LWRP policy standards and
