SUSAN SOUDER requests a Wetland Permit to demolish existing one-story wood frame house; remove 7.5'X 14.7' extension on NE side; add 8.8'X 12.1' extension at NE comer; remove 7.5'X 7.5' slate patio on NE side. In revised footprint, construct full poured concrete basement; construct two-story wood frame house within revised footprint. Abandon existing waste disposal system and construct new waste disposal system at a distance greater than 100' from the seaward face of the bulkhead. Located: 3470 Peeonic Bay Blvd., Laurel. SCTM#128-6-8 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action is INCONSISTENT with the denoted following Policy Standards and therefore is INCONSISTENT with the LWRP. 4.1 Minimize losses of human life and structures from flooding and erosion hazards. The following management measures to minimize losses of human life and structures from flooding and erosion hazards are suggested: A. Minimize potential loss and damage by locating development and structures away from flooding and erosion hazards. No development is permitted in natural protective feature areas, except as specifically allowed under the relevant portions of 6 NYCRR 505.8. 3. Move existing development and structures as far away from flooding and erosion hazards as practical. Maintaining existing development and structures in hazard areas may be warranted for: a. structures which functionally require a location on the coast or in coastal waters. b. water-dependent uses which cannot avoid exposure to hazards. c. sites where relocation of an existing structure is not practical. d. If the action is approved and to further Policy 5: Protect and Improve Water qualit3r in the Town of Southold: 1. Require hay bales during construction. 2. Establish a non-turf buffer landward of the wood bulkhead to protect Great Peconic Bay. Policy 6. Protect and restore the quality and function of the Town of Southold ecosystem. 6.3 Protect and restore tidal and freshwater wetlands. Comply with statutory and regulatory requirements of the Southold Town Board of Trustees laws and regulations for all Andros Patent and other lands under their jurisdiction 1. Comply with Trustee regulations and recommendations as set forth in Trustee permit conditions. The proposed distance to the new residence from the seaward wood bulkhead is 53 feet; the distance from the southeastern corner of the house to the bulkhead is 44 feet; a minimum setback distance of 100 feet from the wetland line is required pursuant to Chapter 275-3.Findings; I~uroosel jurisdiction; setbacks. Please require that the applicant amend the application to meet the above policy to the greatest extent practical. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. [] YEs [] APPLICABLE Policy 2 [ YES Renovations to an existing waterfront dwelling, yielding no net gain in the area of the footprint is consistent with the character of the waterfront community, and be- cause the immediate area is heavily developed it is felt that there is no adverse im- pact on the desired preservation of open space. Infrastructure use is not a factor since the project is for the modification of an exi~qff~e~ while, r?Ia.iaina~ same use. Policy 3 Enhance visual quality and protect scenic resources throughout the Town of Southold. [] YES ~NO [] NOT APPLICABLE The structure proposed will be inconspicuous in the proposed location. It is com- patible with other existing waterfront structures in the area, and will not adversely affect the dynamic landscape elements (tidal fluctuations, seasonal vegetation changes, changing light) which might contribute to ephemeral visual qualities. Natural protective features will not be adversely affected; there is an existing bulkhead. Policy 5 [] YEs Protect and improve water quality and supply in the Town of Southold. ~NO [] NOT APPLICABLE The proposed project will utilize a new Health Department-approved on-site sew- age disposal system. During construction a line of haybales or a silt fence will be in place to minimize the chance of silt entering the bay. There will be no distur- bance of the bay bottom during construction. Policy 6 Protect and restore thc quality and function of the Town of Southold's ecosys- tem. [] YES ~0 [] NOT APPLICABLE There is no wetland vegetation on the site, and as has been mentioned the property is behind an existing bulkhead. Steps will be taken to insure that silt does not enter the bay during construction. The project is not located in a Significant Coastal Fish and Wildlife Habitat. All statutory and regulatory requirements, at all levels of government, will be strictly complied with. No dredging, excavating, or filling of the bay bottom is proposed. Policy 7 Protect and improve air quality in the Town of Southold. [] YES ~O [] NOT APPLICABLE The construction or use of the project as proposed will not result in significant amounts of new air pollution. Policy 8 [] YES Minimize environmental degradation in the Town off Southold from solid O and hazardous substances and wastes. [] NOT APPLICABLE Although the project as proposed may result in the generation of additional solid waste, it will be disposed of in accordance with the required or recommended prac- tices of the Town and the SCDHS. Any handling and storage of petroleum prod- ucts will be accomplished through the use of approved containers and facilities, and approved methods of handling and storage will be followed.
