SUSAN NORRIS C/O ED SAWICKI requests a Wetland Permit to remove and replace in-
kind/in-place 82' of existing bulkhead. Located: 2790 New Suffolk Ave., Mattituck.

The in-kind replacement of and/or removal and disposal of existing timber bulkhead and addition
to return is an exempt Minor Action and not subject to LWRP review pursuant to Chapter 268-
3; Items A and B of the Town of Southold Town Code.
The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the
Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy
Standards. Based upon the information provided on the LWRP Consistency Assessment Form
submitted to this department, as well as the records available to me, it is my recommendation
that the proposed action is exempt from review pursuant to Chapter 268-3, Exempt Minor
Actions, item B which states.
"Replacement, rehabilitation or reconstruction of a structure or facility, in kind, on the same
site, including upgrading buildings to meet building or fire codes, except for structures in areas
designated by the Coastal Erosion Hazard Area (CEHA) law where structures may not be
replaced, rehabilitated or reconstructed without a permit".

A. INSTRUCTIONS
All applicants for pernfits* including Town of Southold agencies, shall complete this CCAF for
proposed actions that are subject to the Town of Southold Waterfront Consistency Review Law. This
assessment is intended to supplement other information used by a Town of Southold agency in
making a determination of consistency. *Except minor exempt actions including Building Permits
and other ministerial permits not located within the Coastal Erosion Hazard Area.
Before answering the questions i,n Section C, the preparer of this form should review the exempt
minor action list, policies and explanations of each policy contained in the Town of Southold Local
Waterfront Revitalization Program. A proposed, action will be evaluated as to its significant
beneficial and adverse effects upon the coastal area (which includes all of Southold Town).
If any question in Section C on this form is answered "yes", then the proposed action may affect the
achievement of the LWRP policy staladard$ and conditions contained in the consistency review law.
Thus, the action should be analyzed in more detail and, if necessary, modified prior to making a
determination that it is consistent to the maximum extent practicable with the LWRP policy
standards and conditions. If an action cannot be certified as consistent with the LWR? policy
standards and conditions, it shall not be undertaken.

uso of a coastal location, and minimizes adverse effects of development.
This is a waterfront piece of property that is presently bulkheaded, The bulkhead is failing and needs
to be reconstructed, All structures are existing, There will be no increased development and our
proposal is an effort to maintain existing structures,

Preserve historic resources of tho Town of Southold.
This property has no significant historic resources,

Enhance visual quality and p.o~ect scenic resources throughout the Town of Southold.
The bulkhead at this location is existing. The present condition of this bulkhead is showing its age by
presenting holes in the sheathing and leaking of backfill. A new bulkhead is just an attempt of the
upland property owner to maintain her property. All structures are existing so the visual quality and
scenic resources will remain the same.
NATURAL COAST POLICIES
Policy 4 Minimize loss of life, structures, and natural resources from flooding and erosion.
The existing bulkhead is needed to protect the upland property. This shoreline is mostly reinforced
with erosion control structures. The new bulkhead will not increase flooding or erosion in this area.

This proposal will not have any impact on the water quality and supply of the Town of Southold.

Our proposal will not limit public access to the coastal waters or public resources of the Town of
Southold. There is a bulkhead presently existing and we are proposing for in-place construction.

Policy 10 Protect the Town of Southold's water-dependent uses and promote siting of now water-
dependent uses in suitable locations.
Our proposal is to reconstruct a failing section of bulkhead. The present condition of the bulkhead is
poor and is unsafe. The construction of a new bulkhead in its place will allow the property owners to
safely approach this waterfront. All structures are in need of reconstruction to maintain the integrity
of this property.
