Located: 200 West Lake Dr., Southold. SCTM#90-1-20 The in-kind replacement of and/or removal and disposal of existing timber bulkhead is an exempt Minor Action and not subject to LWRP review pursuant to Chapter 268-3; Items A and B of the Town of Southold Town Code. The proposed action to construct a 4' x 4' timber deck and 4' x 11' stairs to the beach has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action is generally CONSISTENT with the Policy Standards and therefore is CONSISTENT with the LWRP provided that the following Best Management Practices are applied to further the policies: 1. No CCA is used in the construction of the deck and stairs. 2. A revegetation plan is provided for the bluff following construction to control erosion. Pursuant to Chapter 268 the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. I have indicated that all policies are "Not Applicable," because pursuant to Town Code §268- 5(A) and the corresponding definitions of"action" and "minor action" by §286-3, the submission of a LWRP Consistency Assessmem Form is not required for this application, as the proposed work entails only the "maintenance or repair involving no substantial changes in an existing stxucture or facility," specifically the in-place replacement of an existing bulkhead.
