Located: 1050 Blue Marlin Dr., Southold. SCTM#57-1-32 The in-kind replacement of and/or removal and disposal of existing timber bulkhead and addition to return is an exempt Minor Action and not subject to LWRP review pursuant to Chapter 268- 3; Items A and B of the Town of Southold Town Code. The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action is exempt from review pursuant to Chapter 268-3, Exempt Minor Actions, item B which states. "Replacement, rehabilitation or reconstruction of a structure or facility, in kind, on the same site, including upgrading buildings to meet buiMing or fire codes, except for structures in areas designated by the Coastal Erosion Hazard Area (CEHA) law where structures may not be replaced, rehabilitated or reconstructed without a permit ". ~Town of Sgnthold LWRp CONSISTENCY ASSESSMENT FORM A. DEVELOPED COAST POLZCZES Pollo/1 Foster a pattern of development in Ute Town of SoUthold that enhances community character, preserves open space, makes efficient use of infrastructure, makes beneficial use of a coastal location, and minimizes adverse effects of development. This is a waterfront piece of property presently bulkheaded. The bulkhead is failing and needs to be reconstructed. There will be no increased development and our proposal is an effort to maintain existing structures. Polio/2 Preserve historic resources of the Town of Southold. This property has no significant historic resources. Polio/3 Enhance visual quality and protect scenic resources throughout the Town of Southold. The bulkhead at this location is existing. The present condition of this bulkhead is showing its age by presenting holes in the sheathing and leaking of backfill. A new bulkhead is just an attempt of the upland property owner to maintain her property, The visual quality and scenic resources will remain the same. NATURAL COAST POLICIES Policy 4 Minimize loss of life, structures, and natural resources from flooding and erosion. The existing bulkhead is needed to protect the upland property, This shoreline is mostly reinforced with erosion control structures. The new bulkhead will not increase flooding or erosion in this area, Policy 5 Protect and improve water quality and supply in the Town of Southold. This proposal will not have any impact on the water quality and supply of the Town of Southold. Polio/6 Protect and restore the quality and function of the Town of Southold's ecosystem. This proposal will not have any impact on the Town of Southold's ecosystem. Polio/7 Protect and improve air quality In the Town of Southold. This proposal will not have any impact on the air quality of the Town of Southold. Polio/8 Minimize environmental degradation in the Town of Southold from solid waste and hazardous substances and wastes. This proposal will not degrade the environment with solid waste or hazardous substances. PUBLZC COAST POLi'CI'ES Polio/9 Provide for public access to, and recreational use of, coastal waters, public lands, and public resources of the Town of Southold. Our proposal will not limit public access to the coastal waters or public resources of the Town of Southold. There is a bulkhead presently existing and we are proposing for in-place construction. All structures are landward of the AHWM. WORKZNG COAST POLICII~; Polio/ZO Protect the Town of Southold's water-dependent uses and promote siting of new water- dependent uses in suitable locations. Our proposal is to reconstruct a failing bulkhead. The present condition of the bulkhead is poor and is unsafe.
