INDIAN ROCK REALTY, LLC (BRIAN BRILLE) requests a Wetland Permit to
construct a 4'X 21' wooden stairway on the face of a 9' tall sound-front bluff and clear a
4'X 140' unsurfaced trail within an existing wooded area. Located: 26659 Route 25,
Orient. SCTM#18-3-30.4
The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review
of the Town of Southold Town Code and the Local Waterfront Revitalization Program
(LWRP) Policy Standards. Based upon the information provided on the LWRP
Consistency Assessment Form submitted to this department, as well as the records
available to me, it is my recommendation that the proposed action is generally
CONSISTENT with the Policy Standards and therefore is CONSISTENT with the
LWRP provided that the following Best Management Practices are applied to
further the policies:
1. No CCA is used in the construction of the stairs.
2. A revegetation plan is provided for the bluff following
construction to control erosion.
3. Existing vegetation on the bluff is protected during construction
and the applicant limits the clearing of vegetation to the area
necessary to construct the access stairway.
Pursuant to Chapter 268 the Board of Trustees shall consider this recommendation in
preparing its written determination regarding the consistency of the proposed action.

Project Statement
for the
PROPOSED BLUFF STAIRWAY AND TRAIL.
Situate:

Proposed Cons~uction:
The proposal involves (1) the construction of a 4' x 21' wooden stairway on the face of a 9' tall
soundfront bluff and (2) the clearing of a 4' x 140' unsurfaced trail within an existing wooded area.
The proposed trail will connect the stairway to the currently cleared upland portion of the site.
The entire stairway and approximately 43 1.f. of the trail are proposed seaward of the Coastal
Erosion Line.
The stairway will be supported by (8) 4" x 4" wooden posts and will be elevated at least 1' off the
bluff face. A 2.5' tall wooden handrail is proposed on one side of the structure. All disturbed
areas of the bluff will be landscaped with native grasses and shrubs.
All construction will take place using hand equipment. No large machinery is proposed to be
used. Construction of the stairway should take 1-2 days. Cleating of the trail may take 2-3 days.
The location of the proposed beach stairway was selected on the grounds that this specific
construction site has the lowest grade change along the parcels bluff, thus minimizing the size of
the stairway and its impacts on the site. The proposed trail to the stairway follows existing
pathways within the woodland, thus reducing the number of trees and vegetation to be cleared.
Projected Impacts and Proposed Mitigation:
Considering that only hand equipment will be used to (1) construct the proposed stairway and (2)
to clear vegetation for the trail, it is estimated that disturbance can be kept to a minimum.
Considering that the proposed stairway and trails's dimensions are 4'x21' and 4'x140',
respectively, and assuming 1' of extra disturbance beyond the referenced dimensions, a projected
overall initial site disturbance of 990 square feet can be calculated. Following the proposed
clearing and construction, all disturbed areas located beyond the areas occupied by the stairway
and trail (approximately 346 s.f.) will be re-vegetated with native grasses and shrubs.
INTEr CIENCE
The stairway and trail will take less than one week to complete - so within a week, the site will be
restored with native plants once construction is initiated.
Since some erosion and siltation could occur downslope during the construction phase of the
stairway, a haybale and silt fence boundary could be installed near the base of the bluff to contain
any sediment/soils that could become dislodged from the bluff during a heavy rainfall. However,
since (1) the proposed construction and site restoration is estimated to begin and end within a
week and (2) the project disturbance will be restricted to a very small area, the applicant will
defer to the Town and/or the State as to the appropriateness of constructing a project limiting
fence.
