Hansen Revocable Trust SCTM#78-5-17 CHERYL L. HANSEN REVOCABLE TRUST requests a Wetland Permit to remove and replace (in-place) approx. 98 linear ft. of existing timber bulkheading with vinyl bulkhead; construct +/-14' vinyl bulkhead return on landward side of existing timber return to be cut to grade; remove +/-21' return at boat ramp; and backfill landward of new bulkhead and existing deteriorating boat launching ramp (to be closed) with approx. 18 cy. clean sand fill tracked in from an upland source and approx. 27 cy. spoil to be incidentally dredged from area up to 10' off bulkhead (to maximum depth of 30" ALW). Located: 405 Williamsburg Rd., Southold. SCTM#78-5-17 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. The action is located in a canal adjacent to Corey Creek; Corey Creek is a NYSDEC designated Critical Environmental Area and a New York State Significant Fish and Wildlife Area. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the re¢ords~able to me, it is my recommendation that the proposed action is generally ~NSISTENT ~ith the Policy Standards and therefore is CONSISTENT with the LWRP provided that the following Best Management Practices are applied to further Policies 5 and 6: 1. No CCA- treated lumber is used in the construction of the timber bulkhead. 2. A non-turf buffer at the maximum width practical is established landward of the new bulkhead. 3. A silt curtain is set in place to contain localized turbidity during construction, pursuant to 275-11 (2). Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. Hansen Revocable Trust~ 405 Williamsbur~ Road~ Southold Dear Mr. Terry: Attached please fred an LWRP Consistency Assessment Form, which is being submitted in association with an application to the Board of Trustees for a Town Wetlands Permit to replace an existing timber bulkhead with a vinyl bulkhead and incidentally dredge the area adjacent to the bulkhead to recover lost backfill. I have indicated that ail policies are "Not Applicable," because pursuant to Town Code §268- 5(A) and the corresponding definitions of"action" and "minor action" by §286-3, the submission of a LWRP Consistency Assessment Form is not required for this application, as the proposed work entails only the "maintenance or repair involving no substantiai changes in an existing structure or facility," specificaily the in-place replacement of an existing bulkhead with the use of a silt curtain to contain loeaiized turbidity associated with the incidental dredging.
