HARBOR LIGHTS PROPERTY OWNERS ASSOC. requests a Wetland Permit to remove
15' of existing bulkhead and replace in-like/in-place. Dredge area in front of bulkhead to below -
4.0' AMLW (approx. 8 cy.) and truck spoil off site to approved disposal location. Located: 112
Windjammer Dr., Southold. SCTM#71-2-11.4
The in/kind replacement of and/or removal and disposal of existing timber bulkhead is an exempt
Minor Action and not subject to LWRP review pursuant to Chapter 268-3; Items A and B of the
Town of Southold Town Code, which states:
"Replacement, rehabilitation or reconstruction of a structure or facility, in kind, on the same
site, including upgrading buildings to meet building or fire codes, except for structures in areas
designated by the Coastal Erosion Hazard Area (CEHA) law where structures may not be
replaced, rehabilitated or reconstructed without a permit ".
In addition, the applicant proposes to dredge in front of bulkhead to below -4.0' AMLW
(approx. 8 cy.) and truck spoil off site to approved disposal location. This action has been
reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code
and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the
information provided on the LWRP Consistency Assessment Form submitted to this department,
as well as the records available to me, it is my recommendation that the proposed action is
generally CONSISTENT with the Policy Standards and therefore is CONSISTENT with
the LWRP provided that:
To further support the LWRP and the policies, assess the feasibility of the
installation of a silt boom/turbidity screen to be employed during dredging to
minimize turbidity in the water column.
Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing
its written determination regarding the consistency of the proposed action.

DEVELOPED COAST POLtCIES
Policy I Foster a pattern of development in the Town of Southold that enhances community
character, preserves open space, makes efficient use of infrastructure, makes beneficial
use of a coastal location, and minimizes adverse effects of development.
This is a waterfront piece of property that is presently bulkheaded. The bulkhead is failing and needs
to be reconstructed. The returns are necessary to encapsulate the backfill and prevent further
erosion for the side of the bulkhead. There will be no increased development and our proposal is an
effort to maintain existing structures.

Preserve historic resources of the Town of Southold.
This property has no significant historic resources.
Enhance visual quality and protect scenic resources throughout the Town of Southold.
The bulkhead at this location is existing. The present condition of this bulkhead is showing its age by
presenting holes in the sheathing and leaking of backfill. A new bulkhead is just an attempt of the
upland property owner to maintain her property. The visual quality and scenic resources will remain
the same.
NATURAL COAST POLICIES
Policy 4 Minimize loss of life, structures, and natural resources from flooding and erosion.
The existing bulkhead is needed to protect the upland property. This shoreline is mostly reinforced
with erosion control structures. The new bulkhead will not increase flooding or erosion in this area.
Policy 5
Protect and improve water quality and supply in the Town of Southold.
This proposal will not have any impact off the water quality and supply of the Town of Southoid.
Policy 6
Protect and restore the quality and function of the Town of Southold's ecosystem.
This proposal will not have any impact on the Town of Southold's ecosystem. The project site is
located in a previously dredged canal. Our proposed dredging is an effort to maintain the water
depth that once existed.

This proposal will not have any impact on the air quality of the Town of Southold.
Minimize environmental degradation in the Town of Southold from solid waste and
hazardous substances and wastes.

Policy 9 Provide for public access to, and recreational use of~ coastal waters, public landsr and
public resources of the Town of Southold.
Our proposal will not limit public access to the coastal waters or public resources of the Town of
$outhold. There is a bulkhead presently existing and we are proposing for in-ptace construction.
