Located: 192 Willow Terrace, Orient. SCTM#26-2-7.1 To the south of the property the shoreline is hardened with a timber bulkhead. Aerial photos indicate that the property is subject to erosion and a loss of upland property has occurred. The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action is CONSISTENT with the following Policy Standards and therefore is CONSISTENT with the LWRP. To further sub-policy 4.1; it is recommended that the applicant incorporate "practical vegetation methods" in the design of the structure. Policy Standards 4.1 Minimize losses of human life and structures from flooding and erosion hazards. The following management measures to minimize losses of human life and structures from flooding and erosion hazards are suggested: Use hard structural erosion protection measures for control of erosion only where: Construction of a hard structure is the only practical design consideration and is essential to protecting the principal use. The proposed hard structural erosion protection measures are: a. limited to the minimum scale necessary b. based on sound engineering practices Practical vegetative methods have been included in the project design and implementation. Adequate mitigation is provided and maintained to ensure that there is no adverse impact to adjacent property or to natural coastal processes and natural resources and, if undertaken by a private property owner, does not incur significant direct or indirect public costs. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. Before answering the questions in Section C, the preparer of this form should review the exempt minor action list, policies and explanations of each policy contained in the Town of Southold Local Waterfront Revitalization Program. A proposed action will be evaluated as to its significant beneficial and adverse effects upon the coastal ama (which includes all of Southold Town). If any question in Section C on this form is answered "yes", then the proposed action may affect the achievement of the LWRP policy standards and conditions contained in the consistency review law. Thus, the action should be analyzed in more detail and, if necessary, modified prior to making a determination that it is consistent to the maximum extent practicable with the LWRP policy standards and conditions. If an action cannot be certified as consistent with the LWRP policy standards and conditions, it shall not be undertaken. In addition, subject parcel will be in harmony with this "...beneficial use of a coastal Iocat/on..." in that the subject waterfront lot will be enhanced and improved by the installation of the proposed stone revetment in order to control erosion alonf:l the situate shoreline. The instant r>rar)osal will also "...minimize the adverse effects of development" in that proposed construction above the hiqh water mark and utilization of siltation fencinq and hay bales will reduce the impact caused by the project. The surroundin.q area is currently comprised of properties improved with similar appurtenances (i.e. stone revetments) of similar size and scope. Scenic resources, assumedly views of Orient Harbor, are not at risk because the proposed revetment will not block any views of said resource. In addition, there is an existinq stone revetment that has been in IDlace within this Drocertv for years without neaatively JmpactJn.q upon the scenic resources of this section of waterfront. The existingl stone revetment has existed thereon for many years without resulfinq in any form of discernible adverse effects to the surroundinfl environment. Moreover, stone revetments in and of themselves have not been shown to adversely impact aquatic ecosystems. The proposed stone revetment will prevent any further erosion to the property, thereby preventingj any upland soils from enterincl Orient Harbor. The choice to construct above the hiflh water mark, as appose to construction within the area of normal tidal fluctuations, will further "protect and restore ecological qualify..." by limiting the amount of siltation caused by the instant proposal. Therefore, we feel that the proposal fully complies with Policy 6. Attach additional sheets if necessary Policy 7. Protect and improve air quality in the Town of Southold.
