JAMES GRACE requests a Wetland Permit & Coastal Erosion Permit to remove the existing
stone revetment and install approx. 106 linear ft. ofne~v stone revetment along the situate
shoreline to prevent further erosion. Located: 190 Willow Terrace, Orient. SCTM#26-2-6.1
The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the
To~vn of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy
Standards. Based upon the information provided on the LWRP Consistency Assessment Form
submitted to this department, as well as the records available to me, it is my recommendation that
the proposed action is CONSISTENT with the following Policy Standards and therefore is
CONSISTENT with the LWRP.
To further sub-policy 4.1; it is recommended that the applicant incorporate "practical vegetation
methods" in the design of the structure.
Policy Standards
4.1 Minimize losses of human life and structures from flooding and erosion hazards.
The following management measures to minimize losses of human life and structures from
flooding and erosion hazards are suggested:
D. Use hard structural erosion protection measures for control of erosion only
where:
Construction of a hard structure is the only practical design consideration
and is essential to protecting the principal use.
The proposed hard structural erosion protection measures are:
a. limited to the minimum scale necessary
b. based on sound engineering practices
Practical vegetative methods have been included in the proiect design
and implementation.
Adequate mitigation is provided and maintained to ensure that there is no
adverse impact to adjacent property or to natural coastal processes and
natural resources and, if undertaken by a private property owner, does
not incur significant direct or indirect public costs.
Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing
its written determination regarding the consistency of the proposed action.

LWRP CONSISTENCY ASSESSMENT FORM
INSTRUCTIONS
All applicants for permits* including Town of Southold agenciesi shall complete this CCAF for
proposed actions that are subject to the Town of Southold Waterfront Consistency Review Law. This
assessment is intended to supplement other information used by a_T~n,of Southold agency in
making a determination of consistency. *Except minor exempt actions including Building Permits
and other ministerial permits not located within the Coastal Erosion Hazard Area.
Before answering the questions in Section C, the preparer of this form should review the exempt
minor action list, policies and explanations of each policy contained in the Town of Southold Local
Waterfront Revitalization Program. A proposed action will be evaluated as to its significant
beneficial and adverse effects upon the coastal area (which includes all of Southold Town).
If any question in Section C on this form is answered "yes", then the proposed action may affect the
achievement of the LWRP policy standards and conditions contained in the consistency review law.
Thus, the action should be analyzed in more detail and, if necessary, modified prior to making a
determination that it is consistent to the maximum extent practicable with the LWRP policy
standards and conditions. If an action cannot be certified as consistent with the LWRP policy
standards and conditions, it shall not be undertaken.
A copy of the LWRP is available in the following places: online at the Town of Southold's website
(southoldtown.northfork.net), the Board of Trustees Office, the Planning Department, all local
libraries and the Town Clerk's office.

Policy 1. Foster a pattern of development in the Town of Southold that enhances community character,
preserves open space, makes efficient use of infrastructure, makes beneficial use of a coastal location, and
minimizes adverse effects of development. See LWRP Section IH - Policies; Page 2 for evaluation
criteria.

Subject ProPosal is consistent with the policy in that the sitin~ and utilization of the improved erosion -
control facilities li.e. stone revetment) will maintain the character of the surroundin.q nei.qhborhood, which
currently consists of other similarly improved lots with similar accessory structures (i.e. slone revetments to the
north and south along Orient Harbor). In addition, subject parcel will be in harmony with this "...beneficial
use of a coastal location..." in that the subject waterfront lot will be enhanced and improved by the
installation of the proposed stone revetmenl in order to control erosion alonq the situate shoreline. The
instant proposal will also "...minimize fDe adverse effects of development" in that proposed construction
above the hi.qh water mark and utilization of siltation fencinq and hay bales will reduce the impact caused
bv the IDroiect. Accordin.qly, we feel that the instant proposal complies with Policy 1.

to install a stone revetment alonq the situate shoreline of the subject parcel The surroundinq area is
currentJy comprised of properties improved with similar appurtenances Ji.e. stone revetments) of similar size
and scope. Scenic resources, assumedly views of Orient Harbor, are not at risk because the proposed
revetment will not block any views of said resource. In addition, there is an existinfl stone revetment on the
adjacent property that has been in place for years without ne.qatively impactingl upon the scenic resources
of this section of waterfront. Therefore, we feel that the instant proposal complies with Policy 3.

Subject proposal will fully comply with this Policy in that the proposed stone revetment is specifically
desiqned to minimize and/or prevent loss of life, structures and natural resources from floodin~ and erosion.
In addition, the proposed construction above the hi,th water mark, rather than construction within the area
of normal tide fluctuations, will help to "manaqe naviqatian infrastructure to limit adverse impacts on
coastal processes" by drastically reducinq the amount of siltation caused by the project and thereby
limitinq impacts to the naviqation of Orient Harbor. Therefore, we feel that the instant propasal complies
with Policy 4.

Subject proposal will maintain the quality of the surroundinq ecosystem in that the proposal is to simply
install a stone revetment. Stone revetments in and of themselves have not been shawn to adversely impact
aquatic ecosystems. The proposed stone revetment will prevent any further erosion to the property,
thereby preventingl any upland soils from entering1 Orient Harbor. The choice to construct above the hi.qh
water mark, as appose to construction within the area of normal tidal fluctuations, will further "protect and
restore ecoloqical quality..." by limitin~ the amount of siltation caused by the instant proposal. Therefore,
we feel that the praposal fully complies with Policy 6.
