CHARLES BOYAR requests a Wetland Permit to reconstruct the existing functional timber
bulkhead with vinyl sheathing within 18" of said existing bulkhead, and to re-vegetate a 2'X
150' area immediately seaward of the reconstructed bulkhead with Spartina altemiflora. Located:
250 Goose Creek Lane, Southold. SCTM#71-1-42
The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the
Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy
Standards. Based upon the information provided on the LWRP Consistency Assessment Form
submitted to this department, as well as the records available to me, it is my recommendation
that the proposed action is CONSISTENT with the Policy Standards and therefore is
CONSISTENT with the LWRP provided that the following best management practice is
applied pursuant to § 275-11. Construction and operation standards.
(2) Erosion control. Installation of an erosion control structure is necessary during any
building, grading, landscaping or site work activity within Trustee jurisdiction. This structure
may include, but is not limited to, installation of a silt fence, hay bales, wood chip berm and silt
booms. The placement of the erosion control structure(s) shall be determined by the Trustees or
their designee. Ail intertidal construction and excavation requires the installation of a silt
boom that will retain ali suspended sediments within the immediate project area.
Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing
its written determination regarding the consistency of the proposed action.

LWRP CONSISTENCY ASSESSMENT FORM
A. INSTRUCTIONS
All applicants for permits* including Town of Southold agencies, shall complete this CCAF for
proposed actions that are subject to the Town of Southold Waterfront Consistency Review Law. This
assessment is intended to supplement other information used by a Town of Southold agency in
making a determination of consistency. *Except minor exempt actions including Building Permits
and other ministerial permits not located within the Coastal Erosion Hazard Area.
Before answering the questions in Section C, the preparer of this form should review the exempt
minor action list, policies and explanations of each policy contained in the Town of Southold Local
Waterfront Revitalization Program. A proposed action will be evaluated as to its significant
beneficial and adverse effects upon the coastal area (which includes all of Southold Town).
If any question in Section C on this form is answered '~yes", then the proposed action may affect the
achievement of the LWRP policy standards and conditions contained in the consistency review law.
Thus, the action should be analyzed in more detail and, if necessary, modified prior to making a
determination that it is consistent to the maximum extent practicable with the LWRP policy
standards and conditions. If an action cannot be certified as consistent with the LWRP policy
standards and conditions, it shall not be undertaken.
A copy of the LWRP is available in the following places: online at the Town of Southold's website
(southoldtown.northfork.net), the Board of Trustees Office, the Planning Department, all local
libraries and the Town Clerk's office.

DEVELOPED COAST POLICY
Policy 1. Foster a pattern of development in the Town of Southold that enhances community character,
preserves open space, makes efficient use of infrastructure, makes beneficial use of a coastal location, and
minimizes adverse effects of development. See LWRP Section III - Policies; Page 2 for evaluation
criteria.

Subject proposal is consistent with the policy in that the sitinq and utilization of the improved erosion -
control facilities li.e. reconstructed bulkheadin~l) will maintain the character of the surroundin~l
neiflhbarhood, which currently consists of many similarly improved lots with similar accessory structures (i.e.
existinq bulkheadin.q to the northeast and sauthwest alonfl Goose Creek). In addition, subject parcel will
be in harmany with this "...beneficial use of a coastal location..." in that subject waterfront lot will be
enhanced and improved by the up.qradinq of the existinq bulkhead in order to control erosion alonq the
situate shoreline. The instant propasal will also "...minimize the adverse effects of development" in that
resheathinfl, rather than reconstruction, will drastically reduce the siltation caused by the project. This will
protect the Town awned clam beds situated near the subject parcel, and will not add to the naviflational
issues associated with Goose Creek. Accordinqly, we feel that the instant proposal complies with Policy 1.

Subject proposal will not adversely impact the visual quality of the surrounding1 area in that the proposal is
to install a vinyl sheathed bulkhead within 18" of the existing wooden bulkhead located along the situate
shoreline of the subject property. The surroundinq area is currently comprised of properties improved with
similar appurtenances (i.e. bulkheading) of similar size and scope. Scenic resources, assumedly views of
Goose Creek and Southold Bay beyond, are not at risk because the proposed resheathin~l will occur on an
existinfl functional bulkhead that has been in place within this property far years without neflatively
impacting1 upon the scenic resources of this section of waterfront. The proposed resheathinq will also
"...restore deteriorated...visual components" by coverinq the worn wooden bulkheadinfl and thereby
addin.q to the visual quality of the area. Therefore, we feel that the instant proposal complies with Policy 3.

NATURAL COAST POLICIES
Policy 4. Minimize loss of life, structures, and natural resources from flooding and erosion. See LWRP

Subject proposal will fully comply with this Policy in that the proposed bulkhead resheathinq is specifically
desiqned to minimize and/ar prevent loss af life, structures and natural resources from floodin~l and erosion.
In addition, the proposed resheathin~l, rather than reconstruction, will help to "manaqe naviqation
infrastructure to limit adverse impacts on coastal processes" by drastically reducinq the amount of siltation
caused by the project and thereby limitin~l impacts to the already naviqationally challenqed areas of
Goose Creek. Therefore, we feel that the instant proposal complies with Policy 4.

Subject proposal will maintain the quality of the surrounding1 ecosystem in that the proposal is to simply
resheath the existin~ timber bulkheadin~ thereon with vinyl bulkheadinq. The existing bulkhead has existed
thereon for many years without resultinq in any form of discernible adverse effects to the surroundinq
environment. The choice to resheath, as oppose to replace, the existinq bulkhead will further "protect and
restore ecoloqical quality..." by limitin.q the amount of siltation caused by the instant proposal. The
applicant is also proposing1 to veqetate an area 2' seaward of the proposed bulkhead with native beach
~lrass ISpartina}, which will add in the furtherance of these qoals. This voluntary ve.qetation will also "protect
and restore tidal...wetlands" where previously there was iust timber bulkheadin~l. More importantly, the
specifics of this proposal (i.e. resheathinq, veqetation seaward af the proposed bulkheadl will further aid in
protection of the Town owned clam beds located in Goose Creek near the project site, and will reduce
adverse effects to the nay qat anal challenqes of Goose Creek.
